The subject of the contract is the provision of a service consisting in exercising investor supervision in the field of management, control as well as conducting procedures and documentation of financial acceptance of construction works carried out during the implementation period, warranty and warranty of the project entitled "Reconstruction and extension of the existing system of coastal fortifications at the height of the town of Mielno" implemented in the design-build system.

1. The subject of the contract is the provision of a service consisting in exercising investor supervision in the field of management, control as well as conducting procedures and documentation of financial acceptance of construction works carried out during the implementation period, warranty and warranty of the project entitled "Reconstruction and extension of the existing system of coastal fortifications at the height of the town of Mielno" implemented in the design-build system.

2. Investor supervision will be established to implement the project in accordance with its assumptions, in particular regarding its scope, financial and material settlements of deadlines constituting the scope of works indicated in the Construction Contract.

3. The undertaking constituting the subject of investor supervision will be implemented under the operational program 'Infrastructure and Environment', priority axis II, ie 'Supporting investments targeted at specific types of threats while increasing disaster and disaster resilience and developing disaster management systems'.

4. The scope of construction works covered by investor's supervision includes the performance of the following elements of hydrotechnical buildings as part of the implementation of the project entitled "Reconstruction and extension of the existing system of coastal fortifications at the height of the town of Mielno":

1) renovation of shore spur complex - 36 items;

2) construction of a heavy type erratic band with a length of approx. 450 m;

3) modernization of the existing coastal band on km 299.420 - 300.010 according to UM;

4) modernization of the existing coastal band at km 300,010–300,260 according to UM;

5) modernization of the existing coastal band at km 300.260–300.380 according to UM;

6) refulation, artificial debris supply in an amount of at least 100,000 m 3 .

5. Investor's supervision should be exercised on the principles and in a manner consistent with the provisions of the contract and the construction law in force in Poland, i.e. in particular the Act of 7.7.1994 Construction Law (i.e.: Journal of Laws 2019, item 186, as amended .).

6. Based on the concluded contract, according to the model contract, Annex 3 to the ToR, the investor's supervision will perform its duties in close cooperation with the Employer, the Contractor of works in the design-build system and, if necessary, with the author's supervision of the Functional and Utility Program.

7. The Employer reserves the performance by the Contractor of key parts of the contract, i.e. entrusting the duties of Resident Engineer and Deputy Resident Engineer only to the Contractor's own potential.

8. A detailed description of the subject of the contract is provided in Annex 9 to the ToR.

9. Estimated value of construction works: 'Reconstruction and extension of the existing system of coastal fortifications at the height of the town of Mielno' over the implementation, which the Contractor will supervise is 45 155 330.39 PLN net, VAT 0%.

10. The planned period of implementation of construction works covered by supervision is included in Chapter 5. However, the required minimum period of quality guarantee for construction works subject to supervision is 60 months. Investor's supervision constituting the subject of the contract includes supervision during warranty inspections and over the removal of any defects and defects during the warranty period and / or warranty for construction works that are covered by the abovementioned a minimum 60-month warranty on the subject of the contract (the period may be extended). The Awarding Entity's rights under the due performance of the contract, pursuant to art. 471 of the Civil Code, for investor supervision expire after 12 months from the date of expiry of the rights under the guarantee and warranty for construction works.
