1. The subject of the currently awarded contract is the summer cleaning of the road surface of streets with an area of 1 165 735.38 m2 being in the Management Board of MZUiM in Chorzów

2. A detailed description of the subject of the contract includes Annexes 4, 4a, 5, to the SWZ.

The contracting authority does not allow the submission of a variant offer.

1) The Contracting Authority imposes on the Contractor obligations in the scope of:

(a) separate collection, separate export, as required by law, of waste which will appear on the property under maintenance or will be generated as a result of activities arising from or related to the performance of the procurement contract;

b) management of municipal waste collected from properties covered by maintenance – to the extent that it is the obligation of the person actually in possession of the property – the Contractor is obliged to implement it in the manner specified in the applicable law.

2) As part of the provision of the service, the provisions contained in the detailed scope of services contained in Annex JW must be complied with

I. Summer cleaning of road surfaces

In the period from July 1, 2023 to October 31, 2023. The Contractor is obliged to clean the roadway of streets included in Annex 5 to the SWZ in the summer.

Works related to summer cleaning will be commissioned according to the current needs of the Ordering Party.

The summer maintenance of the roads in question will consist of:

a) mechanical and manual cleaning, according to the current needs of the Ordering Party, of the roadways of streets commissioned by the Ordering Party for cleaning along their entire width and length,

b) mechanical and manual cleaning, according to the current needs of the Ordering Party, of road components, i.e. bus bays, islands located in the roadway, asylums, roundabout rings, parking spaces,

c) current determination by the Ordering Party (according to the needs and discretion of the Ordering Party) of the roadways to be cleaned in accordance with Annex 4a to the SWZ,

d) ordering by the Ordering Party (list of selected street roadways from Annex 5 to the SWZ) according to the needs and discretion of the Ordering Party,

e) the Contractor's reaction to the commencement of the implementation of the summer maintenance of the Chorzów roadway commissioned for cleaning by the Contracting entity within the time limit set by the Contracting entity.

f) securing the area during the execution of works,

(g) the collection, loading, transport and transfer of waste resulting from the disposal or recovery operations carried out;

h) ensuring telephone communication with the Ordering Party during the performance of the service.

i) The number of cleaned roadways and the scope of works included in the cleaning is decided on an ongoing basis by the Ordering Party, depending on the prevailing weather conditions and the current pollution of the roadway in Chorzów.

II. Other provisions:

1. The works covered by the public contract shall be carried out in accordance with the provisions of health and safety at work and taking into account the requirements for the operation of mechanical equipment used in the performance of the contract.

2. The Contractor is obliged to proceed with the implementation of the task to such an extent as not to cause a safety threat to road users and pedestrian traffic. In the event of negligence, the Contractor bears financial responsibility towards the injured parties.

3. In the event of a breakdown of vehicles indicated in Table 1, point VIII.1.3) letter c) of SWZ, the Contractor is obliged to inform the Contracting Authority about the fact. The Contractor is obliged for the time of repair from the moment of occurrence of the damage - defects to substitute and use (in order to perform the service) a replacement car with parameters not worse than the car that has failed.
