The subject of the contract is the purchase of electricity between 01.06.2022 and 31.05.2023 for the facilities of the Company “Kieleckie Waterworks”, in accordance with the provisions of the Energy Law Act of 10 April 1997 (uniform text Journal of Laws of 2021, item 716 as amended).

1. The subject of the contract is the purchase of electricity between 01.06.2022 and 31.05.2023 for the facilities of the Company “Kieleckie Waterworks”, in accordance with the provisions of the Energy Law Act of 10 April 1997 (uniform text Journal of Laws of 2021, item 716 as amended).

2. Pursuant to Article 441 of the Pzp Act, the Contracting Authority provides and the Contractor agrees to the right of options. The option is covered by the subject of the order indicated in paragraph 1 above, with the minimum amount of electricity supplied to 14,500 MWh.

3. The Contracting Authority, after supplying by the Contractor of the quantity of electricity referred to in point 2 above at the time of implementation of the Agreement, reserves the right to carry out further energy supply over the minimum quantity, up to a quantity of not more than 17 000 MWh.

4. The Ordering Party provides for the possibility of exercising the right of options in case of increasing the current needs of the Ordering Party. The condition for activating the right of options is to submit a written declaration of will by the Contracting Authority regarding the exercise of the right of options within the scope specified by the Contracting Authority. The submission by the Ordering Party of a declaration of exercise of the right of options results in the obligation of the provision on the part of the Contractor, from which the Contractor may be exempt only by prior written under the rigour of nullity by the Consent of the Contractor. If the Contractor does not exercise the right of options, the Contractors shall not be entitled to any claim for the execution of the subject matter of the contract falling within the scope of the law.

5. The Contractor under this contract is obliged to provide services for the resale of electricity generated by the Ordering Party in renewable electricity sources and in terms of trade balancing under the principles laid down by the provisions of the Law Act Energy of 10 April 1997 (uniform text Journal of Laws of 2021, item 716 as amended), in accordance with the applicable implementing acts to the abovementioned law and the provisions of the Act of 23 April 1964. Civil Code (uniform text Journal of Laws of 2020r, item 1740 as amended), the rules laid down in the concessions, the provisions of the Agreement concluded as a result of this procedure and based on the Law of Pzp.
