Old Town1. The subject of the contract is the comprehensive maintenance of urban green areas in the Old Town.

3. The Contracting Authority informs that pursuant to Article 139(1) of the Public Procurement Law, it will first carry out an examination of the
and evaluate tenders, and will then make the qualification of the contractor whose offer has been the highest rated as regards the grounds for exclusion and the fulfilment of the conditions for participation in the proceedings.
4. The Contracting Authority requires the Contractor or subcontractor to employ on the basis of an employment contract throughout the entire period of performance of the subject matter of the contract, persons in the number declared in the offer performing physical activities and operating equipment in works related to mowing lawns, care of shrubs and young trees, ongoing maintenance and minor repairs of elements of small architecture, monuments and places of national remembrance, maintaining order and cleanliness in dog runs and tidying up toilets for dogs, performing minor cleaning works (e.g. after windstorms), repair and renovation work.

5. Provisions concerning equivalent solutions are specified in point 6 of the Terms of Reference.
6. Tender deposit in the amount of: PLN 10,000.00 (say: ten thousand zlotys)
should be lodged before the deadline for submission of tenders. The validity period of the defect should be in accordance with the date of binding the tender.

7. Within 3 years from the date of awarding the basic contract, the contracting authority may award the existing contractor a contract consisting in the repetition of similar services referred to in Article 214(1)(7) of the Public Procurement Law, i.e.: raking lawns along with the removal of grass, leaves and impurities, repair of lawns along the roadway with turf repair, lawn mowing, maintenance of shrubs, perennials, grasses, trees, flowerbeds, hedges, supplementary planting of trees, shrubs, perennials, grasses, etc. and sowing grasses, flower beds, cleaning alleys, squares, stairs, clearing sand from alleys and adjacent lawns and along the roadway after winter along with turf repair, ongoing maintenance and ongoing repairs of all elements of small architecture as well as monuments and places of national remembrance, Ongoing cleaning of green areas from pollution, including paddock areas, gyms, snow removal and graying of alleys and stairs, emptying bins and refilling bags for dog excrement, replacing sand in dog toilets, maintaining irrigation systems, maintaining cleanliness in playgrounds, parklets and small architecture - maintenance, supplementation, replacement of plantings in the location referred to in point 1.1 of the Terms of Reference.
The deadline and price will be determined through negotiations, but the deadline may not be longer than: 12 months from the date of signing the contract for the performance of the repeated task, and the price may not exceed PLN 451,851.85 net
The award of a contract consisting in the repetition of similar services is a unilateral, discretionary decision of the Contracting Authority and depends on budget constraints and satisfaction with the quality of services provided under the basic contract.
