The subject of the contract is the collection of municipal waste generated in the Wilkowice municipality and coming from: - from owners of real estate where residents live, - from owners of real estate where residents do not live, and there are summer cottages or other real estate used for recreation and leisure purposes, on which waste is generated, referred to in Resolution No. XII/103/2019 of the Wilkowice Commune Council of October 30, 2019, On the day of signing the contract, the Contractor will receive from the Contracting Authority a detailed list of real estate/address points from which municipal waste will be collected. During the implementation of the contract, the lists will be updated on an ongoing basis. The planned quantities of Mg units during the contract implementation period and the minimum and maximum amounts of waste collected during the contract implementation period are specified in the offer form constituting Annex 1 to the SWZ. A detailed description of the subject of the contract is included in Annex 3 to the SWZ.
1. The Contractor is obliged to collect municipal waste: a) continuously, not disturbing the night rest (from 700 to 2000), b) on dates resulting from the adopted collection schedule, c) regardless of weather conditions, d) regardless of the difficulties caused by road repairs, detours, e) in emergency situations - lack of access, e.g. road repair, difficult weather conditions, the Contractor's employees will be obliged to approach the property located in a hard-to-reach place in order to empty the containers or collect bags with waste or collect waste on another day, after prior arrangement with the Ordering Party. f) vehicles adapted to receive individual waste fractions, in a way that excludes mixing of separately collected waste of different types with each other and separately collected municipal waste with mixed municipal waste, g) regardless of narrow, unpaved and difficult access to the property and from real estate, access to which is a road with a limited vehicle weight of up to 3.5 tons, h) in the case of a complaint submitted by the Ordering Party regarding the service provided, in particular failure to collect municipal waste on time, failure to deliver bags for segregated waste to property owners, etc. Within 48 hours of receipt of the notification. After completing the complaint, the Contractor shall immediately notify the Contracting Authority about this fact. i) if the intervention reported by the resident, which is provided by the Contracting entity to the Contractor, is unjustified (e.g. the container / bag was not issued by the resident) on the day of receipt, then the Contractor is obliged to make a handwritten note about the lack of waste (bag / container) and document it with a photo (photographic documentation should be dated and time, allowing to determine the absence of waste exposure), and then forward this information to the Ordering Party, which will be the basis for waste collection at the next date in accordance with the schedule for a given region. j) in the event of non-compliance of segregation, the Contractor is obliged to prepare documentation enabling the proceedings to be carried out in order to issue an administrative decision changing the fee for municipal waste management, applying the amount of the increased fee rate (photographic documentation with a date allowing for the assignment of containers or bags to a specific property and a written statement of the Contractor's employee who found the incompatibility of segregation confirmed legible signature). 2. The Contractor is obliged to collect all municipal waste specified in Table 1: • collected in containers and/or bags that meet the minimum requirements set out in the Regulations for maintaining cleanliness and order in the Wilkowice Commune - applies to non-segregated (mixed) municipal waste, glass, paper, plastic and metal waste, multi-material packaging waste, bio-waste excluding green waste and ashes from domestic furnaces. The Contractor is obliged to equip the properties covered by the subject of the contract on an ongoing basis with bags in which waste will be collected in a selective manner, in accordance with the provisions of Chapter IX of this OPZ, • exhibited by residents in front of the property or in places designated for waste collection, at garbage gazebos – applies to all collected waste. 3. The contracting authority provides for the award of a contract consisting in the repetition of similar services, referred to in Article 214(1)(7) of the Act, up to a maximum of 30% of the value of the basic contract.
