1. The subject of this contract is the supply of operating lamps with image and data management system in operating rooms for the Oncology Center - the Institute. Maria Skłodowska-Curie branch in Gliwice.
2. A detailed description of the subject of the contract is contained in the "Specification and price specification" constituting Annex 2 to the ToR, "Technical parameters" constituting Annex 3 to the ToR and "IT infrastructure" constituting Annex 4 to the ToR.
1. The subject of this contract is the supply of operating lamps with image and data management system in operating rooms for the Oncology Center - the Institute. Maria Skłodowska-Curie branch in Gliwice.
2. A detailed description of the subject of the contract is contained in the "Specification and price specification" constituting Annex 2 to the ToR, "Technical parameters" constituting Annex 3 to the ToR and "IT infrastructure" constituting Annex 4 to the ToR.
3. The Awarding Entity, before awarding the contract, to confirm that the offered subject of the contract meets the requirements specified by the Awarding Entity, will call the Contractor whose tender has been rated the highest to be submitted within a designated period of not less than 10 days, valid as at the date of submission of the following documents:
a) declaration of conformity or CE certificates (confirming the CE marking for the offered operating lamps and image and data management system in operating rooms),
b) catalogs or folders of the manufacturer containing descriptions of the offered operating lamps, image and data management system, LAN cabling system and LAN switch. Required catalogs or folders of the producer should contain pictures of the offered subject of the order (it is not allowed to replace the pictures with drawings).
4. Whenever the content of the ToR, in the scope of the description of the subject of the contract, refers to a trade mark, patent or origin, it is assumed that such indication is accompanied by the term "or equivalent". In this case, the Employer allows the possibility of submitting an offer equivalent to the description of the subject of the contract presented in the contract, however, provided that the equivalent product proposed by the Contractor will meet all the requirements described by the Employer in the ToR. The product proposed as equivalent may not differ in quality, standard, functionality, technical parameters from those required by the Employer, and its use will in no way affect the proper functioning as intended. The Contractor who refers to equivalent solutions is required to demonstrate that the products offered by him meet the requirements specified by the Employer (Article 30 (5) of the Public Procurement Law). The burden of proof in proving the equivalence of the products offered with the requirements described by the Employer lies with the Contractor submitting an equivalent offer. The contractor must demonstrate in detail in the content of the offer the equivalence of the products offered.
5. The Employer determines that on 20.8.2019 at 8:00 on the premises of the Employer, i.e.
Oncology Center - Institute of Maria Skłodowska-Curie Branch in Gliwice, ul. Wybrzeże Armii Krajowej 15, 44-101 Gliwice, POLAND.
A local visit will take place, the purpose of which will be for Contractors to check the place and conditions related to the implementation of the subject of the contract.
The meeting of participants of the local vision will start in:
Public Procurement and Purchasing Department, Directorate Main Building, Ground floor, Meeting Room, room No. 103
Comments:
- the Employer suggests to Contractors the legitimacy of participation in the local vision, but does not impose such an obligation on them (participation in the vision is the right, not the obligation of the Contractors),
- failure to recognize the subject of the contract under the local vision will not result in the disqualification of the offer,
- the risk related to e.g. incorrect calculation of the price or underestimation of the offer due to the lack of participation in the local vision is fully borne by the Contractor,
- in connection with the determination of the local vision, the Ordering Party has set a deadline for submitting bids longer than the minimum deadline specified in the Public Procurement Law.
