The subject of the contract is the comprehensive sale of high-methane natural gas with the symbol E with a total estimated volume of 31 186 051 kWh during the delivery period, to the facilities listed in Annex 6 to the ToR. The Contractor shall make all actions and arrangements with DSOs necessary to carry out the procedure of changing the seller and effectively start selling gas, including in particular: termination of existing comprehensive gas fuel contracts, termination of existing gas fuel sales contracts, notification of new comprehensive gas fuel sales contracts to DSO. The Contractor shall perform these activities on the basis of appropriate powers of attorney granted by each of the Employers listed in Chapter 1 SIWZ, along with the conclusion of comprehensive gas fuel sales agreements. A detailed description of the subject of the contract, among others the list of tapping points with tariff groups, contracted capacities and planned quantities of gaseous fuel consumption is included in Annex 6.
1. The subject of the order is the comprehensive sale of high-methane natural gas with the symbol E with a total estimated volume of 31 186 051 kWh during the delivery period, to the facilities listed in Annex 6 to the ToR.

The Contractor shall make all actions and arrangements with DSOs necessary to carry out the procedure of changing the seller and effectively start selling gas, including in particular: termination of existing comprehensive contracts for gas supply, termination of existing gas sales contracts, notification of new comprehensive fuel sales contracts to DSO gas. The Contractor shall perform these activities on the basis of appropriate powers of attorney granted by each of the Employers listed in Chapter 1 SIWZ, along with the conclusion of comprehensive gas fuel sales agreements.
3. A detailed description of the subject of the contract, among others the list of tapping points with tariff groups, contracted capacities and planned quantities of gaseous fuel consumption is included in Annex 6 to the ToR.
4. The supplied gaseous fuel must meet the technical standards in accordance with the provisions of the Energy Law (i.e. Journal of Laws of 2019, item 755, as amended), executive acts and Polish standards issued on its basis.
5. The expected consumption of gaseous fuel is binding and serves to compare offers, the Contractor should allow the Employer the opportunity without cost deviations from the expected consumption by at least 15% in total for the entire volume. The indicated tolerance regarding the volume being the subject of the contract should be understood as the option right established by the Employer within the meaning of the provisions of art. 34 section 5 of the PPL Act.
6. The rates of distribution fees that the Employer used in the calculation of the amount indicated in Annex 1 to the ToR come from the current local DSO tariff. During the contract, they may change if the local DSO's tariff changes.
7. The sale of gaseous fuel will take place on the basis of contracts concluded separately by each of the Employers, indicated in Chapter 1 of the ToR, with the following in relation to the Employers: Dobczyce Commune, Myślenice Commune, Siepraw Commune, Sułkowice Commune, Tokarnia Commune, and Myślenicki Poviat also based on contracts concluded separately by local government organizational units, which will be separate payers, and which are described in detail in Annex 6 to the ToR.
8. The implementation of the subject of the contract will take place in accordance with the provisions of the Energy Law and executive acts issued on its basis.
