Description:
Reception and management of waste from the territory of the Municipality of Wojnicz

The subject of the contract is the collection and management of waste from the area of the Wojnicz Commune divided into 2 parts:

Part 1 - Collection and management of municipal waste from property owners living in the Wojnicz Municipality.

• A detailed description of the subject of the order for part 1 can be found in Annex 1.1. to SWZ – Description of the Subject of the Order.

Part 2 – Collection and management of solid waste from municipal facilities, municipal cemetery and cleaning of markets, streets and squares as well as organizational units in the Wojnicz Commune, divided into two areas:

1) Scope I: Collection of solid waste from municipal facilities, municipal cemetery from cleaning markets, streets and squares.

2) Scope II: Collection of solid waste from organizational units.

• A detailed description of the subject of the contract for part 2 can be found in Annex 1.2. to SWZ – Description of the Subject of the Order.

Part 1 - Collection and management of municipal waste from property owners living in the Wojnicz Municipality.

3.2.1. Part 1 - Reception and development of municipal waste from property owners residing from the territory of the Community of Wojnicz.

• A detailed description of the subject of the order for part 1 can be found in Annex 1.1. to SWZ – Description of the Subject of the Order.

• The amounts of waste specified in the offer form divided into individual fractions of waste are maximum quantities. The Ordering Party reserves the right to reduce the scope of the order, which is tantamount to incomplete use of the quantities resulting from the offer form. The actual amounts of waste to be collected may differ from those stated and will depend on the actual demand of the Ordering Party. However, the minimum scope of the contract carried out by the contractor will not be less than 70% of the quantity of individual fractions of waste indicated in the offer form.

3.3. Order with the right of option - part 1:

3.3.1. The scope of the basic contract consists of the quantities of waste broken down by individual fractions of waste in Mg/year specified in the offer form. The Contracting Authority provides for the possibility of exercising the right of option in the scope of up to a maximum of 10% increase in the collection and management of the amount of waste divided into individual fractions specified in the offer form.

3.3.2. The power to exercise the right of option will be related to the Ordering Party's current needs for the need to collect and use more waste than the amount of waste provided for in the tender form resulting from the amount of waste generated by residents.

3.3.3. In order to run the option, the Contracting Authority shall provide the Contractor in writing a statement in which he will express his will to exercise the right of option and to determine the extent to which he enjoys the right of option. The submission of the declaration shall take place no later than 14 days before the date of the service covered by the right option. In the event of exercising the right of option, the Contracting Authority shall provide the Contractor with the statement referred to in the first sentence, 30 days before the completion of the contract covering the basic scope of the contract.

3.3.4. In terms of an optional order, the Contractor is obliged to start providing the service on the basis of a written statement by the Contracting Authority to exercise the right of option.

3.3.5. Use of the option right by the Ordering Party may be made at one time for the entire value of the optional order or in several parts. If the options are exercised in several parts, the Contracting Authority shall submit further statements to the Contractor no later than before the maximum scope arising from the option law is exhausted.

3.3.6. The Contracting Authority stipulates that the contract covered by the right of option will be executed under the terms of the basic contract, in accordance with the provisions of this Agreement, the SWZ and the Contractor's offer.

3.3.7. In the event of the Contractor exercising the right of option, the Contractors shall be paid for the actual quantities of received and developed municipal waste. The Contractor's remuneration for the performance of the service covered by the right option shall be calculated on the terms provided for in this Agreement and on the basis of the unit prices indicated by the Contractor in the tender, the list of which includes Annex 1 to the contract.

3.3.8. The right of option is a unilateral entitlement of the Ordering Party, from which he may, but is not obliged to exercise in the course of the object of the contract. In the event that the Contractor does not exercise the right of option, the Contractors shall not be entitled to any claim in this respect.

3.3.9. The Contracting Authority's use of the option right does not require the preparation of an annex to the contract.

Part 2 – Collection and management of solid waste from municipal facilities, municipal cemetery and cleaning of markets, streets and squares as well as organizational units in the Wojnicz Commune

Part 2 – Collection and management of solid waste from municipal facilities, municipal cemetery and cleaning of markets, streets and squares as well as organizational units in the Wojnicz Commune, divided into two areas:

1) Scope I: Collection of solid waste from municipal facilities, municipal cemetery from cleaning markets, streets and squares.

2) Scope II: Collection of solid waste from organizational units.

• A detailed description of the subject of the contract for part 2 can be found in Annex 1.2. to SWZ – Description of the Subject of the Order.

Right of Option Part 2:

The scope of the basic contract consists of the quantities of containers/containers/bags to be collected and disposed of during the term of the contract specified in the offer form. The Ordering Party provides for the possibility of exercising the right of option to increase the number of containers / containers / bags to be collected and disposed of to a maximum of 50% of the quantities specified in the offer form. The above applies only to Scope I: Collection of solid waste from municipal facilities, municipal cemetery from cleaning markets, streets and squares.

The right to exercise the right of option will be related to the current needs of the Ordering Party regarding the need to collect and manage more waste than the amount of waste provided for in the offer form, resulting from the amount of waste generated by residents.

In order to activate the option, the Ordering Party shall provide the Contractor, in writing, with a statement in which it expresses its willingness to exercise the right of option and specifies to what extent it exercises the right of option. The submission of the statement will take place no later than 7 days before the date of performance of the service covered by the option right. If the right of option is exercised, the Ordering Party shall provide the Contractor with the statement referred to in the first sentence, at the latest 30 days before the completion of the contract covering the basic scope of the contract.

In the scope of an optional contract, the Contractor is obliged to start providing the service on the basis of a written statement of the Ordering Party on the exercise of the right of option.

The exercise of the right of option by the Ordering Party may be made once for the entire value of the optional order or in several parts. In the case of exercising the option in several parts, the Ordering Party shall submit further statements to the Contractor no later than before the maximum scope resulting from the right of option is exhausted.

The Ordering Party reserves that the contract covered by the right of option will be carried out on the terms of the basic contract, in accordance with the provisions of this contract, SWZ and the Contractor's offer.

If the Ordering Party exercises the right of option, the Contractor shall be entitled to remuneration for the actual amounts of municipal waste collected and managed. The Contractor's remuneration for the performance of the service covered by the option right will be calculated on the terms provided for in this contract and on the basis of unit prices indicated by the Contractor in the offer, the list of which includes Annex 1 to the contract.

The right of option is a unilateral right of the Ordering Party, which may or may not be used as part of the implementation of the subject of the contract. If the Ordering Party does not exercise the right of option, the Contractor shall not be entitled to any claims in this respect.

The exercise by the Ordering Party of the right of option does not require the preparation of an annex to the contract.
