6.1.6. The Contracting Authority requires that the Tender be accompanied by the evidence specified in clauses 6.1.2., 6.1.3 and 6.1.4 to confirm the compliance of the offered supplies with the requirements specified in the description of the subject of the contract.
6.3. Before selecting the most advantageous offer, the Contracting Authority shall call on the contractor whose offer has been rated the highest to submit within the prescribed period, not shorter than 10 days, the following statements or documents valid as at the date of submission:
6.3.1 List of statements or documents made by the Contractor in the proceedings at the request of the contracting party in order to confirm the absence of grounds for exclusion:
(a) the declaration in the form of a European Single Procurement Document drawn up in accordance with the model standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 at the date of submission. UE nr L 3, 6.1.2016, p. 16/- Annex 2 to SWZ.
NOTE: In Part IV of the ESP: The contractor's selection criteria are fulfilled only by part of the α.
NOTE: Declaration indicated in Part III D: Other grounds for exclusion that may be provided for in the national legislation of the Member State of the contracting authority or contracting entity) takes into account the grounds set out in Article 7(1) of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and for the protection of national security.
In the case of joint application by economic operators for the award of a contract, the contracting authority shall examine whether there are grounds for exclusion in respect of each of these economic operators, a single document shall be submitted by each of the economic operators acting jointly.
b) the Contractor's statement on the validity of the information contained in the statement referred to in Article 125(1) of the Act (ESPD), with respect to the grounds for exclusion from the procedure indicated by the Contracting Authority, referred to in:
a) Article 108 (1) (3) of the Act,
(b) Article 108 (1) (4) of the Act concerning the ruling of the prohibition of applying for a public contract under a precautionary measure,
(c) Article 108 (1) (5) of the Act concerning the conclusion of an agreement with other contractors to distort competition,
d) Article 108 (1) (6) of the Act,
accordance with Appendix 16 to the Terms of Reference.
c) the Contractor's statement, within the scope of Article 108(1)(5) of the Act, that it does not belong to the same capital group within the meaning of the Competition and Consumer Protection Act of 16 February 2007 (i.e. Journal of Laws of 2023, item 1689, as amended) with another Contractor who has submitted a separate offer, or a statement that it belongs to the same capital group together with documents or information confirming the preparation of the offer, independently of another Contractor belonging to the same capital group, in accordance with Appendix No. 16 to the Terms of Reference
(d) Declarations of the contractor/contractor jointly applying for the contract CONDITIONS FOR EXCLUSION UNDER ARTICLE 5K OF REGULATION 833/2014, in accordance with Annex 15 to the Terms of Reference.
e) information from the National Criminal Register concerning:
Article 108(1)(1) and (2) of the Act of 11 September 2019 - Public Procurement Law, hereinafter referred to as the "Act", Article 108(1)(4) of the Act, concerning the prohibition of applying for a public contract as a penal measure - drawn up not earlier than 6 months before its submission
f) an excerpt or information from the National Court Register or from the Central Register and Information on Economic Activity, prepared no earlier than 3 months before its submission, if separate regulations require an entry in the register or register, in order to confirm the lack of grounds for exclusion under Article 109(1)(4) of the Public Procurement Law.
