5.1. The subject of the contract - comprehensive implementation in the "design and build" tasks titled truck scale for trucks with a roof, at the entrance to the Plant.
The task consists of the following parts:
A. Projektowa
- preparation of complete project documentation along with obtaining all arrangements required by law, opinions and permits.
B. Executive
- execution of construction and installation works and obtaining the occupancy permit for the Investment.
1. The subject of the contract - comprehensive implementation in the "design and build" mode tasks truck scale for trucks with a roof, at the entrance to the Plant. The task consists of the following parts:
A. Projektowa
- preparation of complete project documentation along with obtaining all arrangements required by law, opinions and permits.
B. Executive
- execution of construction and installation works and obtaining the occupancy permit for the Investment.
2. A detailed description of the subject of the contract has been presented in the Functional and Utility Program constituting Volume III of the ToR.
3. Detailed rules for the performance of the contract are contained in Volume II of the Terms of Reference. Draft contract.
4. Information on the requirements referred to in art. 29 paragraph 3a:
4.1. The contracting authority requires employment on the basis of an employment contract by the contractor or subcontractor of all persons performing all works and construction works that are the subject of this contract during the performance of the contract. Ww. works include:
- engineering and construction works,
- electrical installation works,
- road construction works.
The above requirement does not apply to persons regarding whom the Contractor demonstrates that the above. the activities will not be performed in any way under the management and at the place and time designated by the Contractor or Subcontractor, and as a rule he does not apply to the Works Manager. This requirement also does not apply to self-employed people and company partners who themselves carry out work related to the subject of this contract.
4.2. During the performance of the contract, the contracting authority is entitled to perform inspection activities against the contractor regarding the fulfillment by the contractor or subcontractor of the employment requirement under the employment contract of the persons performing the tasks indicated in point 4.1 activities. The contracting authority is entitled in particular to:
1) demand statements and documents regarding confirmation of compliance with the abovementioned requirements and assessing them,
2) demand explanations in case of doubts as to confirmation of compliance with the abovementioned requirements
3) carry out controls at the place of performance.
5. Equivalent solutions should be understood as those which present a description of the subject of the contract with the same or better technical, quality and functional parameters meeting the minimum parameters specified by the Employer, but marked with a different trademark, patent or origin. The condition for using equivalent solutions is written approval by the Employer. The differences between the referenced standards and their equivalents must be described in detail by the Contractor and submitted to the Employer for approval.
In accordance with art. 30 paragraph 5 of the Act, the Contractor who refers to equivalent solutions described by the Employer is obliged to demonstrate that the supplies, services or works offered by him meet the requirements specified by the Employer.
6. Subcontracting:
a) The Employer does not reserve the obligation for the Contractor to perform key parts of the contract personally,
b) The contractor may entrust the performance of part of the contract to the subcontractor,
c) The Employer requests the Contractor to indicate the part of the contract which it intends to entrust to subcontractors, and to provide the Contractor with the companies of subcontractors, in accordance with point 10 Volume I (IDW) of the SETC.
7. The task was submitted for co-financing from the European Union - the Cohesion Fund under the Operational Program Infrastructure and Environment 2014-2020 as part of the project "Development of the Jarocin Waste Management Plant - Wielkopolskie Centrum Recyklingu".
