1. The subject of the contract is the delivery of brand new, from the production of the year 2022/2023 aviation battery charging stations with diagnostic and measurement sets in the assortment and quantities specified in the Price Form constituting Annex 1 to the SWZ along with the training of persons in their use, consistent with the current technical documentation of the manufacturer of products and meeting the Operational and Technical Requirements set out in Annex 2 to the SWZ.

1. The subject of the contract is the delivery of brand new, from the production of the year 2022/2023 aviation battery charging stations with diagnostic and measurement sets in the assortment and quantities specified in the Price Form constituting Annex 1 to the SWZ along with the training of persons in their use, consistent with the current technical documentation of the manufacturer of products and meeting the Operational and Technical Requirements set out in Annex 2 to the SWZ.

2. The Contractor, at its own expense, shall conduct theoretical and practical training of persons designated by the Recipients in a place agreed by the Contractor with the Recipient of the device, in accordance with the provisions of § 8 of the draft provisions of the contract constituting Annex 3 to the SWZ.

3. The delivered products must be complete, technically functional and ready to start operation. The Contractor should comply with the provisions of the Act of 27 April 2001. Environmental law. (Journal of Laws of 2022, item 2556, as amended).

4. In order to confirm that the offered products meet the operational and technical requirements specified in Annex 2 to the SWZ, the Contracting Authority requests that the said evidence indicated in Chapter IV be submitted together with the offer.

5. The Contractor shall provide a guarantee for the subject of the contract for a period of at least 24 months, counting from the date of signing the acceptance-handover protocol by the representatives of the Contractor and representatives of the Recipient.

6. The Ordering Party reserves the right of option. Under the option right, the Ordering Party may additionally order the delivery of a product in the assortment and up to the maximum quantity specified in Annex 1 to the Draft provisions of the contract constituting Annex 3 to the SWZ. The optional order will be executed at the same unit prices as in the basic order, in accordance with the offer submitted by the Contractor. The Contracting Authority shall inform the Contractor in writing about the intention to exercise the option right by 31.08.2023 at the latest. The contracting authority reserves that it will be able to order the delivery of products under the right of option in the event of obtaining funds for this purpose and when the interest of the Polish Armed Forces requires it. The delivery order for a part of the order under the option right is a right and not an obligation of the Ordering Party.

7. Detailed conditions for the performance of the contract are specified in the draft provisions of the contract constituting Annex 3 to the SWZ.
