6.4.1 List of statements or documents made by the contractor in the proceedings at the request of the contracting authority to confirm the absence of grounds for exclusion:

(a) current at the date of submission of the declaration in the form of a single European procurement document drawn up in accordance with the model standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016. EU No L 3, 6.1.2016, p. 16/, Annex No 3 to SWZ/

(b) the allowance or information from the National Court Register or from the Central Records and Business Activities Information drawn up not earlier than 3 months prior to its filing, if separate provisions require entry in the register or records, in order to confirm the absence of grounds for exclusion pursuant to Article 109 (1) (4) of the Pzp Act;

(c) if the Contractor is established or domiciled outside the territory of the Republic of Poland, instead of the documents referred to in:

1) b — files a document or documents issued in the country where the contractor is established or domiciled, confirming that no liquidation has been opened or declared bankrupt.

2) The documents referred to in point 1) should be issued no earlier than 3 months prior to its submission.

3. If, in the country where the contractor is established or domiciled, the documents referred to in point 1 are not issued, they shall be replaced, respectively, in whole or in part, by a document containing the statement of the contractor accordingly, indicating the person or persons entitled to his or her representation, or declaration of the person to whom the document was intended to concern, taken under oath, or, if in the country where the contractor is established or domiciled, there are no provisions of a declaration under oath, made before a judicial or administrative authority, a notary, a body of self-government professional or economic, competent by virtue of the seat or place of residence of the contractor.

(d) In the case of joint application by the contractors for the award of a contract, the contracting authority shall examine whether there is no basis for exclusion against each of those contractors, the documents in point (a) (b) shall be submitted by each of the contractors jointly.

(e) Where the Contractor relies on the capacities or situations of the entities making the resources available, the Contractor shall provide, together with the statement referred to in point 6.4.1.a) of this SWZ, a statement of the resource sharing entity confirming the absence of grounds for exclusion of this the entity and accordingly fulfilling the conditions for participation in the proceedings to the extent that the contractor relies on its resources.

(f) The provisions of point (c) shall apply accordingly to entities providing resources located or domiciled outside the territory of the Republic of Poland.

6.4.2. List of statements or documents submitted by the contractor in the proceedings at the request of the contracting authority to confirm the conditions of participation in the proceedings:

(a) authorisation for the marketing of medicinal products in accordance with the law of 6 September 2001 Pharmaceutical Law /t.j. OJ 2020 item 944/

6.5. Rules for participation in the proceedings of contractors jointly applying for the award of a contract.

6.5.1. Contractors jointly applying for the award of the contract are required to appoint a representative to represent them in the procedure or to represent them in the procedure and conclusion of the public procurement contract. A written power of attorney should be attached to the offer.

6.5.2. Contractors jointly applying for the contract shall be jointly and severally liable for the performance of the contract.

6.5.3. The Employer reserves the right to request Contractors submitting a joint bid to submit to the Employer a contract specifying their mutual relations before concluding the contract.

6.5.4. Contractors jointly applying for the award of the contract shall also mean contractors who are partners in a civil law partnership.

6.6. To the extent not regulated by the SWZ, the provisions of the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on the means of evidence in question and other documents or statements which may be requested by the contractor /Journal of Laws of 2020, item 2415/

6.7. The Contractor shall not be obliged to make statements or documents proving the absence of grounds for exclusion if the Contracting Party has statements or documents relating to that contractor or may obtain them through free and public databases, in particular public records within the meaning of the Act of 17 February 2005 on the computerisation of the activities of entities carrying out public tasks /i.e., Journal of Laws of 2020, item 346 of the c./ For this purpose, the Contractor shall indicate in the submitted offer the source (address) of the database or procedure where the relevant statements or documents are located in the Contracting Authority.

If the Contractor does not provide in the submitted offer the source (address) of the database or proceedings relating to the writedown or information from the National Court Register or from the Central Registry and Business Information, the Contracting Authority to confirm the absence of grounds for exclusion from the proceedings will benefit from documents found in generally available databases.

6.8. If the contractor does not submit the statements and documents referred to in point 6.3.1. of this SWZ, the statements or documents are incomplete, contain errors, the contracting officer will request their submission, supplement, correction within the time limit indicated, unless despite their submission, the contractor's offer it would be subject to rejection regardless of submission, supplement or correction or invalidation of the proceedings.

5. CONDITIONS OF PARTICIPATION IN THE PROCEEDINGS

Contractors who can apply for the contract:

5.1.They shall not be excluded as regards the grounds for exclusion of the contractor referred to in Article 108 (1) of the Pzp Act;

5.2. They fulfil the conditions for participation in the proceedings set out in Article 112 (2) (2) of the Pzp Act concerning the power to conduct a certain business or professional activity, provided that it is due to separate provisions:

The Contracting Authority shall consider the condition to be fulfilled if the Contractor demonstrates that he has the power to carry out a certain activity or activity if it has authorisation to trade medicinal products in accordance with the Act of 6 September 2001. Pharmaceutical law, i.e., Journal of Laws 2020 item 944 of the col./

5.3. In the case of Contractors jointly applying for the award of a contract, the Contracting Authority shall require that at least one of the contractors comply with the condition set out in point 5.2. subject to the distribution of the obligations set out in the contract governing the cooperation of the contractors. The condition set out in point 5.1. each of the contractors jointly applying for the award of the contract should comply with independently.

5.4. In the case of joint application by the contractors for the award of a contract, the contracting authority shall examine whether there is no basis for exclusion against each of these contractors.

5.5. The Contracting Authority provides for the exclusion of the contractor pursuant to Article 109 (1) point 4 of the Pzp Act: in respect of which liquidation has been opened, bankruptcy declared, whose assets are managed by a liquidator or court, has concluded an arrangement with creditors whose economic activities are suspended or is located in another such situation arising from a similar procedure provided for in the rules of the place of initiation of that procedure.

5.6. The Contracting Authority, in proceedings pursuant to Article 139 of the Pzp. Act, will first examine and evaluate tenders, and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and fulfils the conditions for participation in proceeding.
