►A contractor who invokes the use of equivalent solutions is obliged to prove that the solution offered by him meets the requirements specified by the Contracting Authority in the description of the subject of the contract (Article 101(5) of the Public Procurement Law).
In connection with the reference to Polish standards in the description of the subject of the contract, the Ordering Party allows equivalent products with physicochemical characteristics with a higher or lower percentage of their content in the product by a maximum value of +/- 1%, provided that they ensure better quality of the product and the safety of its consumption. Equivalence may not include an increase in the required percentage of water and fat content or a reduction in the protein content fixed above the percentage.
If the Contractor refers to equivalent solutions, he is obliged to attach with the offer:
a list of products with equivalent solutions applied
description of equivalent solutions, e.g. detailed product sheet, declaration of conformity, laboratory test report, confirming the compliance of physico-chemical and quality properties of a given product in relation to those described by the Ordering Party.
A contractor who does not offer equivalence is not obliged to submit descriptions and materials as above.
►The Contracting Authority requires the Contractors submitting the offer to lodge a bid bond before the deadline for submitting tenders in the total amount of PLN 60,000.00. The Contractor is obliged to lodge a bid bond for the entire period of validity of the offer.
