The subject of the contract is the successive supply of diesel oil to the company's petrol stations located in Zawiercie at 53 Podmiejska Street in an estimated amount of 500 m3, i.e. approx. 41 m3/month. The supplied diesel fuel will be used for refuelling cars and other equipment used by the Ordering Party

A. General description of the order

The subject of the order is the successive supply of diesel oil to the company's stations

located in Zawiercie at ul. Podmiejska 53

in an estimated amount of 500 m3, i.e. approx. 41 m3/month. The supplied diesel fuel will be used for refuelling cars and other equipment used by the Ordering Party.

B. Detailed characteristics of the subject matter of the contract.

1. The Contracting Authority reserves the right to purchase a different quantity of diesel oil than specified in the Terms of Use and the Agreement due to changes in circumstances that could not have been foreseen in advance and beyond the Contracting Authority's control. In such a situation, the Contractor shall not raise any objections or claims.

2. The supplied diesel fuel should comply fully with the PN – EN 590+A1:2017-06 standard.

3. The offered fuels must meet the quality requirements specified in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (i.e. Journal of Laws of 2015, item 1680, as amended).

4. Deliveries will be made on working days from Monday to Friday, from 7.00 a.m. to 1.00 p.m., on average once a week in quantities up to 6m3, provided by the Contractor

equipped with a "KAMLOK 3" connector and a fuel pump and meter with a printer.

5. The quantities of diesel supplied are to be invoiced at the actual temperature.

6. The Contractor is always obliged to complete a part of the order within two days from the moment of placing the order by phone and/or e-mail.

7. The Contractor is obliged to strictly comply with the provisions of the Act of 9 March 2017 on the road and rail monitoring system for the transport of goods (Journal of Laws of 2020, item 859). With each delivery, the Contractor should present a certificate of quality of the supplied diesel fuel. Failure to comply with the requirement will result in non-acceptance of delivery and contractual penalties for late delivery.

8. At each delivery, in the presence of the Contracting Authority's representative, the Contractor will be obliged to take samples of diesel fuel from the tanker truck, into a one-litre dated bottle and leave it with the Ordering Party in order to enable inspection in case of doubts as to the quality of the supplied diesel fuel. The Contractor is responsible for the correct collection of the sample.

9. The Contractor shall be liable to the Contracting Authority for defects in diesel fuel which reduce its value or usefulness and in the event of incurring losses as a result, the Contractor undertakes to cover them.
