NVE, hereafter also called the contracting authority, invites tenderers to participate in an open tender contest for framework agreements for legal consultancy services within energy, water resources management, and climate changes for the projects that the International Section (IN) manages. Details on the type of assignments and the actual thematic areas are in annex 1.
NVE's international work includes activity as an advisor for Norad and UD, as well as NVE's assignments for institution contracts with selected cooperation countries and EEA programmes. NVE's International Section has had assignments in 2022 in the following countries: Angola, Bulgaria, Georgia, Croatia, Mozambique, Nepal, Poland, Romania, Slovakia, and Uganda. The international work within development assistance is regulated through a cooperation agreement between NVE and Norad, Grant Agreements and In-house Procurement Agreements and Institutional Cooperations Agreements for most of the cooperation programmes, and MOUs (memorandum of understanding) for some cooperation programmes. There is a separate cooperation agreement between FMO (Financial Mechanism Office) and NVE for the EEA- and Norway Grants. Assistance in the energy field is being reorganised, so that new agreement models could be relevant in the future. It is also possible that programmes in which several government bodies participate could be normal. As a main rule, the expectation is that the departments with professional responsibility for a field procure services for it in such cases.
NVE uses internal competence as well as competence from other government administration bodies (self-management) when this is natural based on the administration bodies´ assignments, but the programmes often have needs for competence that are broader than this, or more capacity than what can be mobilised internally. In 2022 the total spent was approx. NOK 2.2 million (excluding VAT) on legal consultancy work within IN's programmes within international development assistance.

IN is not obliged to procure a specific amount of service in the framework agreement period, but will be loyal to the tenderer regarding the procurement of relevant services. IN also has framework agreements for assistance with technical and economic reviews.
We expect that the value of the procurement in the contract period will be approx. NOK 8,000,000 excluding VAT, including options. The maximum value for the framework agreement is NOK 12,000,000 excluding VAT. The framework agreement does not include an obligation for call-offs and there is no procurement obligation.
Based on plans and experience, the contracting authority assumes that the scope of procurements under the framework agreement is expected to be approx. NOK 1 million - NOK 2 million a year split between 3-5 call-offs a year. This is, however, only an estimate and awards under the framework agreement can be both more or less wide-ranging. Experience shows that there can also be large variations from year to year.
Atttention is drawn to the fact that the framework agreement involves a right, but not a duty, for the contracting authority to use it.
