1. The subject of the order is a technical assistance service in the field of software being at the disposal of the National Heritage Institute.

2. A detailed description of the subject of the order has been included in Annex No. 1-OPZ.

3. Due to the limited number of characters that can be entered into the content of the announcement, full information is contained in the Specification of Essential Terms of the Contract (hereinafter referred to as "ToR") and attachments to the ToR, regarding this procedure available with this announcement on the platform of the procurement platform " e-Contracting "of the Otwarty Rynek Elektroniczny SA company, ul. 1. The subject of the order is a technical assistance service in the field of software being at the disposal of the National Heritage Institute

2. Technical assistance must include software at the disposal of the Employer, i.e .:

1) GeoMedia WebMap Professional ONE v. 2016 - 1 license

2) Geospatial SDI ONE v. 2016 - 1 license

3) Geospatial Portal ONE v. 2016 - 1 license

4) GeoMedia Professional v. 2016 CC * - 7 licenses in the CC version

5) GeoMedia Professional v. 2016 NL ** - 8 licenses in the NL version

6) GeoMedia Smart Client Professional v. 2016 - 1 license

or software in the latest version existing on the market on the day of delivery of the license corresponding to the functionality of the aforementioned products.

3. In all cases in which the Purchaser indicates trademarks, patents or origin of the subject of the order, the Ordering Party allows equivalent solutions, subject to compliance with the rules and requirements described in the ToR. The terms used in SIWZ indicating the trademarks, patents or origin of the subject of the order should be read with the words: or equivalent. Proposed equivalent solutions must be of the same utility, functional and quality parameters, or exceed them.

4. Employer pursuant to art. 29 para. 3 and uPzp requires employment by the Contractor or a subcontractor based on a contract of employment within the meaning of the Act of 26.6.1974 - Labor Code (ie Journal of Laws of 2018, item 917, as amended), in the time limit adequate work for entrusted tasks, persons performing the following activities, including the minimum remuneration for work determined on the basis of the Act of 10.10.2002 on the minimum remuneration for work (Journal of Laws No. 200, item 1679, as amended), throughout the duration of the contract: activities described in the OPZ in point 4 lit. c) to f).

5. The method of documenting the employment of persons referred to in art. 29 para. 3 and uPzp, the Employer's rights to control the Contractor's compliance with the requirements referred to in art. 29 para. 3 a and sanctions for non-compliance with these requirements are set out in Annex 7 to the ToR (draft contract).
