The subject of the contract is the Contractor's provision of electricity to the Employer for the purpose of street lighting, buildings and facilities managed by the Głogów Młp. Commune, EkoGłog and other organizational units of the Commune. This order does not include electricity distribution services.
The subject of the contract is the supply of electricity in accordance with the provisions of the Energy Law (consolidated text of the Journal of Laws of 2019, item 755) to the facilities listed in Annex 1 to the ToR.

The estimated electricity demand for the period: 01/03/2020 - 28/02/2022 is 5 911 490 kWh (i.e. 2 955 745 kWh - per year).

The Employer obliges the Contractor to perform the resulting activities
From the power of attorney constituting Annex 2 to the draft contract, in particular to:
1) notification for the implementation of the contract for the sale of electricity concluded with the Contractor to the Distribution System Operator, making declarations of will and determining on behalf of the Employer all necessary information regarding the termination of the contract for the sale of electricity
And the provision of distribution services (comprehensive agreement)
2) Conclusion, on behalf of the Employer, of the existing comprehensive contract, a contract for the provision of distribution services with the indicated Distribution System Operator, based on the relevant power of attorney or the Employer's statement of consent to conclude a contract for the provision of electricity distribution services with the given Distribution System Operator, granted by the Employer according to the template applicable at the given Contractor, provided that the Employer encloses the said power of attorney or statement together with the signing of the contract (draft contract - Annex 3 to the ToR).
Prior to concluding the contract, the contractor is to have a valid general contract with PGE Dystrybucja SA, enabling the sale of electricity through the DSO distribution network to all of the Employer's facilities, in accordance with Annex 1 to the ToR.
The contracting authority informs that due to the nature of the contract, the exact consumption of electricity covered by the subject of the contract cannot be determined. For this reason, the Employer has provided an estimated amount of electricity consumption. The Employer anticipates that the actual amount of electricity consumption may change, i.e. increase or decrease while maintaining the offered unit prices. Thus, the forecast energy consumption described does not constitute an obligation for the Employer to purchase energy in the given amount.
The Purchaser declares that he has the appropriate legal titles and the right to purchase electricity for the facilities indicated in the proceedings.
At the request of the Employer, it is possible to increase or decrease the number of objects (collection points) listed in Annex 1 to the ToR. This change may not exceed 20% of the number of collection points. Increasing tapping points or changing the tariff group is only possible within tariff groups that have been included in the Terms of Reference and valued in the Contractor's Bid Form.
The order will be implemented from 01/03/2020 to 28/02/2022 or from the conclusion of the Agreement until 28/02/2022 if the Agreement is concluded after 01/03/2020.
