The subject of the contract is a comprehensive supply of high-methane natural gas for facilities located in the territory of Local Government Units: Brzostek Commune 39-230, Biecz Commune 38-340, Czarna Commune 39-215, Dębowiec Commune 38-220, Jasło Commune 38-200, Jodłowa Commune 39-225, Kołaczyce City Commune 38-216, Nowy Żmigród 38-230, Osiek Jasielski 38-223, Pilzno 39-220, Sękowa 38-307, Skołyszyn 38-242, Żyraków Commune 39-204, Jasło City 38-200, Grybów City Commune 33-330, Jasielski County 38-200, Gorlice County 38-300 together with organizational units and cultural institutions listed in point 3.1.4. 3.2. Gas supply will take place on the basis of an agreement specifying the conditions for the sale and provision of gas transmission or distribution services (comprehensive agreement) and will be performed in accordance with the provisions of the Act of 10 April 1997. Energy law, Civil Code and executive regulations issued on their basis. 3.3. The organizational units listed in point 3.1.4. will separately conclude contracts resulting from this public procurement procedure in the open tender procedure, the purpose of which is to ensure a comprehensive supply of high-methane natural gas for the above-mentioned facilities in the period from 01.01.2024. to 31.12.2025r. The volume of gas consumption is estimated at 78 374 436 kWh for the contracting authority and the listed units of local government units, of which an estimated 71 012 618 kWh will be covered by tariff protection under the Act of 26 January 2022 on special solutions for the protection of gas fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202). Due to the nature of the procurement, it is not possible to determine the exact consumption of methane natural gas covered by the contract. For this reason, the Ordering Party presented a foreseeable amount of high-methane natural gas consumption. The Ordering Party anticipates that the actual amount of high-methane natural gas consumption may change, i.e. increase or decrease while maintaining the offered unit prices. Thus, the described forecast consumption of high-methane natural gas does not constitute an obligation for the Ordering Party to purchase high-methane natural gas in the given amount. As part of the performance of this contract, the Contracting Authority provides for the right of option based on Article 441 of the PPL. By the right of option, the Ordering Party understands the possibilities of performing the contract to a wider extent than specified in these proceedings. The right of option is a right of the Ordering Party which may or may not be exercised in the performance of this contract. The right of option will consist in increasing the volume of the ordered natural gas to 10% of the volume indicated in Annex 4 to the SWZ, by submitting an appropriate order by a given Ordering Party.
