The subject of the contract is the supply of electricity to the plant "EKO DOLINA" Sp. z o.o. in Łężyce, with specific, in accordance with the applicable regulations, quality standards – Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819).
The subject of the contract is the supply of electricity to the plant "EKO DOLINA" Sp. z o.o. in Łężyce, with specific, in accordance with the applicable regulations, quality standards – Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819).
As part of the subject of the contract, the Contractor undertakes to:
1. supply of electricity to the Contracting Authority within the meaning of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws 2022.1385), based on the generally accepted B23 tariff, in the estimated amount: 20 MWh for the period from 1 January to 31 May 2024 (minimum benefit 5 MWh) - electricity consumption point: Al. Park Krajobrazowego 99, Łężyce, PPE: 59 0243 8360 1268 4254, connection capacity 1000 kW, registration number of the consumption point 2918.
2. purchase of electricity produced by the Contracting Authority and fed into the distribution network in the estimated amount of 800 MWh for the period from 1 January to 31 May 2024, under the conditions described in the model agreement, constituting Appendix No. 4 to the Terms of Reference,
3. services performed by the Contractor the function of the entity responsible for commercial balancing (hereinafter referred to as "POB"), referred to in Article 3 point 40 of the Act of 10 April 1997. Energy Law, both in relation to electricity supplied to the Ordering Party and purchased from it (i.e. Journal of Laws 2022.1385).
It is estimated that the purchase of electricity in individual zones is estimated:
Zone I: 9.2 MWh/a;
II strefa: 1,6 MWh/a;
III strefa: 9,2 MWh/a.
The Contractor (Energy Supplier) throughout the entire period of performance of the contract must have concluded an appropriate contract with the DSO, enabling the sale of electricity to the Ordering Party's facilities via the DSO distribution network.
The amounts of electricity indicated above are estimates. The amount of electricity actually purchased by the Ordering Party from the Contractor and/or actually sold by the Contractor during the term of the contract may differ from the values given above with the limit of the amount of increase or decrease to 20% of each of these values. A decrease in the energy purchased from the Contractor - but not more than 20% of the value indicated above or an increase in the amount of electricity sold by him to the Contractor - but not more than 20% of the value indicated above - does not entail any consequences for the Ordering Party, except for the need to pay for the energy actually consumed and / or the need for the Contractor to pay for the amount of electricity actually sold to him and for performing the function of POB by the Contractor, and the Contractor in this respect is not entitled to any other claims against the Ordering Party, which he waives by signing the contract. The contractor should take into account the fluctuation of collection and sales at the level of up to 20%.
The Contractor shall submit on behalf of EKO DOLINA Sp. z o.o. the said contracts to the so-called "information exchange platform" within 21 days before their effective date, i.e. from 01.01.2024. i.e. notification to the Distribution System Operator (DSO) for the performance of both the agreement for the sale and purchase of electricity concluded with EKO DOLINA Sp. z o.o. for the period I-V.2024, according to the template specified by the DSO.
On behalf of EKO DOLINA Sp. z o.o., the Contractor shall submit to the Distribution System Operator information on the performance of the POB function for EKO DOLINA Sp. z o.o. in the field of commercial balancing both in the direction of consumption (own needs) and in the direction of generation and introduction of electricity into the ENERGA-OPERATOR SA grid. (during the term of the agreements in question, i.e. in the period I-V.2024, according to the template specified by this DSO, within 21 days before the date of commencement of the term of the agreements in question, i.e. 21 days before the date: 01.01.2024.
