Supply of desulphurized (maximum sulphur content of 10 ppm), national (CN 27101943) and alpine (CN 27102011) diesel fuel by motor vehicles of the Trenord fleet, having the specified characteristics in the UNI EN 590 standard in force at the time of delivery and in compliance with the legal provisions in force, as well as the legal provisions on the containment of pollutants emissions. The diesel fuel must be supplied at the plants indicated by the customer. The estimated requirement, purely indicative, is approximately 10 000 000.00 liters/year, with the distinctive detail between national and alpine for each locality, as indicated in “Annex 1 — Trenord diesel plants traction 2021”.
The award will take place following an open procedure, according to the criterion at the lowest price for ancillary costs (i.e. lower surcharge, transport charges, business profits, etc.) expressed in EUR/1 000 l; the price of diesel fuel, indicated in EUR/1 000 l, will be derived from the weekly quotation “max” (excluding the values included in the 'min-max tips') of the petroleum product “auto diesel” of the area of competence “north” of the price list “Internal market extra-network”, published weekly by the Daily Relay in the “Closures of the markets”, published the week before the date of delivery.
The procedure is entirely managed with telematic systems. The offer must be made by the date indicated in point IV.2.2) and in the manner indicated in the tender specification.
Competitors may request any clarifications related to this race by the end of 12:00 on 16.6.2021 using exclusively the messaging service of the online race ( area “messages”). Requests for clarification received by voice, telephone or in any case after the last date indicated above will not be taken into account. The clarifications on the call and/or any substantial information regarding this tender procedure, will be published — by 16:00 on the day 18.6.2021 — on the portal in the appropriate “messages” area or in the “attachments” area of this tender and will be visible to competitors qualified for the competition itself. In the matter of valiance, Article 89 of the Code applies.
The contracting station excludes candidates or competitors in the event of failure to comply with the provisions of the law in force, as well as the subsistence of the circumstances provided for by art. 80 of the code. They constitute further cause of exclusion: the useless course of the regularization period granted by the contracting station pursuant to art. 83, paragraph 9, of the Code; the existence of essential irregularities not remediable as deficiencies in documentation such as not to allow the identification of the content and the person responsible for it. Likewise, tenders which do not comply with the requirements laid down in the tender documents, the observance of which is provided for 'exclusion penalty' will also be excluded. Trenord srl reserves the right to exclude offers formulated by overabundant groupings if the arrangements for constituting the grouping reveal anti-competitive profiles.
The contracting authority will send all communications via the Portal. In the case of temporary groupings, EEIGs, aggregations of network companies or ordinary consortia, even if not yet formally established, the communication sent to the agent is validly given to all the economic operators grouped, aggregated or consortium members. In the event of use, the communication sent to the tenderer is considered validly made to all the auxiliary economic operators.
