1. The subject of the contract is the supply of electricity and distribution for the needs of the operation of municipal facilities in the Zblewo Commune.
2. The total amount of electricity supplied during the contract performance period to all electricity consumption points described in Connector No. 6 to the SWZ is forecast at the level of 1369 MWh.
3. Any change in the estimated consumption (fluctuation at the level of +/- 30%) will not result in additional costs for the Ordering Party, apart from the settlement for the amount of energy actually consumed according to the prices specified in the offer, with the Contracting Authority paying 70% of the volume indicated in paragraph 2.
4. The detailed scope and list of energy consumption points are specified in Appendix 6 to the Terms of Reference.

2. The total amount of electricity supplied during the contract performance period to all electricity consumption points described in Connector No. 6 to the SWZ is forecast at the level of 1369 MWh.
3. Any change in the estimated consumption (fluctuation at the level of +/- 30%) will not result in additional costs for the Ordering Party, apart from the settlement for the amount of energy actually consumed according to the prices specified in the offer, with the Contracting Authority paying 70% of the volume indicated in paragraph 2.

5. The supply of electricity is to be carried out under the conditions specified in the provisions of the Energy Law and the Civil Code and in accordance with the implementing regulations issued on their basis.
6. The projected electricity consumption indicated in Appendix 6 to the Terms of Use is indicative and may differ from the amount of energy actually consumed during the term of the agreement. Reducing or increasing the amount of electricity does not entail any consequences for the contracting authority, apart from the need to pay for the amount of energy actually consumed.
7. The Contracting Authority stipulates that any amendment to the provisions of the law, in particular enabling the "freezing" of electricity price rates, will result in compliance with these provisions of law.
8. The Contracting Authority does not allow the submission of partial offers. Pursuant to Article 91(1) of the Public Procurement Law, the division of a contract into lots is a right of the Contracting Authority, not an obligation. In addition, the division of this contract is inexpedient and would cause significant difficulties in the performance of the contract.
