Establishment and operation of at least two publicly available Municipal Selective Municipal Waste Collection Points, hereinafter referred to as PSZOK, in the 33-month period, not earlier than from 01.01.2023 to 30.09.2025, including at least one in the City of Kęty, in accordance with Article 3(2)(6) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, allow all residents of the municipality easy access to points

1. The subject of the contract includes:

Establishment and operation of at least two publicly available Communal Selective Municipal Waste Collection Points in the Commune of Kęty, hereinafter referred to as PSZOK,

in the period of 33 months, not earlier than from 01.01.2023 to 30.09.2025, including at least one in the City of Kęty, in order to enable all residents of the commune to have easy access to points in accordance with Article 3(2)(6) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities.

A detailed description of the subject of the contract is contained in Appendix No. 3 of the SWZ.

2. The procedure shall be conducted by open tender. The proceedings will be conducted in a reverse procedure, i.e. in application of Article 139(1) of the Act.

3. The Ordering Party does not require the submission of the said means of proof in the proceedings in question

4. The Contracting Authority provides for the award of a contract consisting in the repetition of similar services referred to in Article 214(1)(7) of the Act.

4.1.Scope of services to be awarded: the contracts will consist in the repetition of similar contracts as the basic contracts and will be consistent with the subject of the basic contract, i.e. covered by the open tender and described in Annex 3 to the SWZ.

4.2.The Contracting Authority provides that the value of the contract to be awarded may amount to a maximum of 50% of the value of the basic contract.

4.3.Conditions under which the contract (repetition of similar services) will be awarded:

a) in the event of exhaustion of the amount referred to in §4 section 17 of the contract,

(b)in the case of a protracted procedure for the award of a further contract in an open procedure, which shall also be understood as the failure to resolve the procedure in such a procedure,

c) the award of the contract will be preceded by a single-source procedure, after negotiations with the Contractor,

(d)the rate of remuneration for the establishment and operation of separate collection points for municipal waste and the receipt of municipal waste from residents, their transport and management shall be subject to negotiations.
