The Contracting Authority shall conclude a framework agreement with a maximum of 5/five Contractors who submit the most advantageous offers and are not subject to exclusion and meet the conditions for participation in the procedure. If less than 5/five offers are submitted in the tender which are not subject to rejection and which are not subject to exclusion and which meet the conditions for participation in the procedure, the Contracting Authority shall conclude a framework agreement with all Contractors.

The Ordering Party has determined the maximum estimated quantity of the ordered assortment of furniture in order to evaluate the offers, which will then be used to prepare the ranking. The template of the Framework Agreement constituting Appendix 4 to the Terms of Reference specifies the rules and manner of awarding contracts, referred to as "performance contracts". A detailed description of the subject matter of the contract is included in Appendix 1A to the Terms of Reference, which is the basis for calculating the offer price. Implementation contracts will be awarded on the basis of the current needs of the Contracting Authority on the terms and conditions provided for in the provisions of the implementation agreement attached to the framework agreement.

1. Implementation contracts will be awarded during the term of the framework agreement.

2. A performance contract covered by a framework agreement may be awarded only to a Contractor who is a party to the framework agreement.

3. The Contracting Authority shall specify the detailed scope of the performance contract each time in the invitation to submit implementation offers.

4. A detailed description of the subject matter of the contract is included in Appendix No. 1a to the Terms of Reference - material and price form.

5. Implementation contracts will be awarded on the basis of the current needs of the Contracting Authority on the terms and conditions provided for in the provisions of the implementation agreement with the content in accordance with Appendix 1 to the framework agreement.

6. At the stage of execution of executive orders based on a framework agreement, the offered unit prices of individual pieces of furniture may not be higher than in the offer constituting the basis for considering them as the most advantageous.

7. The conclusion of a framework agreement does not constitute an award of a contract. The fact of concluding a framework agreement does not give rise to an obligation on the part of the Contracting Authority or the Contractors to award performance contracts.
