Providing services of the SAPV according to § 37 b SGB V in conjunction with § 132 d SGB V on the basis of the guideline for the regulation of special ambulatory palliative care of the Federal Joint Committee and the framework contract underlying the tender within the period from 1.2.2019 to 31.1.2023 with at any time the possibility of concluding the contract (open-house model) for the coverage area in Rhineland-Palatinate mentioned under II.2.3).

The health insurance companies in Rhineland-Palatinate intend to enter into a framework agreement with all suitable service providers, which conclusively regulates the provision of services as well as the requirements for the service providers and the remuneration of the services. A contract by service providers who fulfill the contractual minimum requirements is possible at any time until the expiry of the contract, subject to the application deadlines specified under IV.2.2).

The health insurance companies in Rhineland-Palatinate offer the conclusion of non-exclusive framework agreements for the provision of services of the Specialized Outpatient Palliative Care (SAPV) according to § 37 b SGB V i. V. m § 132 d SGBV with possibility at any time of the contract (open-house model) for the coverage area mentioned under II.2.3) within the period from 1.2.2019 to 31.1.2023. The contracts are concluded as part of a so-called "open-house model". In the open-house model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are uniform, individual negotiations are not conducted. The contract terms are a maximum of 48 months, the earliest date of contract is 1.2.2019. Insured persons of the statutory health insurance funds are entitled to benefits according to § 37 b SGB V (SAPV). This refers to pure specialized, interdisciplinary complex service consisting of nursing and medical partial services. In principle, the employed specialists need special training as palliative care specialists or as palliative care physicians. In principle, the service takes place on an outpatient basis in one's own home, nursing home or hospice. Any suitable service provider may become party to the framework contract. He thus assumes a comprehensive non-exclusive supply contract for the coverage area. A contract is possible at any time until the expiry of the contract.

All contracts end no later than 31.1.2023, regardless of the date of the respective contract. An accession or a contract can be made at any time and under the same conditions. Interested companies can request the participation documents as well as the contract documents at the contact address mentioned under I.1). Contracts for SAPV will be concluded for the first time with effect from 1.2.2019. Interested parties wishing to become contract partners on this date must submit the contract documents to be submitted by 2 January 2019 at the address specified under I.3). Subsequent contracts are possible during the 48-month maximum term on the first of each month. Interested parties wishing to become contractual partners for these follow-up appointments must submit the contract documents at the latest by the end of the second month preceding the month of the desired start of the contract (eg receipt 30.04. This publication does not constitute a public contract within the meaning of the 2014/24 / EU Procurement Coordination Directive of the European Parliament and of the Council or of the Public Procurement Law. In order to ensure the widest possible transparency of the intended contracts, it is published in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice will be used. The resulting conceptual requirements, such as the process name "Open Procedure", are solely due to the use of this announcement form and the publication platform. A further meaning, in particular a submission under procurement regulations, as far as they are not obligatory for legal reasons, is not connected with this.
