Delivery and implementation of servers, network devices with a management and analysis system and technical support service and manufacturer's warranty for a period of 36 months for the equipment supplied.
1. The subject of the contract is the delivery and implementation of servers, network devices, along with a management and analysis system and a technical support service and a manufacturer's warranty for a period of 36 months for the equipment supplied.
2. Delivery and implementation shall include the following elements:
1) Network switch Type A - pcs. 4,
2) Network switch Type B - pcs. 2,
3) Type-C network switch - pcs. 2,
4) Network switch Type D - pcs. 2,
5) Network switch Type E - pcs. 4,
6) Protection device against distributed network attacks, pcs. 2,
7) Analysis and management systems – pcs. 1,
8) RACK server - pcs. 10,
9) SAN switch – pcs. 4,
10) Matrix type 1 – pcs. 1,
11) Matrix type 2 – pcs. 1.
A detailed description of the subject of the contract is included in Annex 1 to the SWZ – OPZ.
3. Pursuant to Article 441 of the PPL, the contracting authority allows the exercise of the right of option. Under the option right, the Contractor shall additionally deliver and implement:
1) RACK server - pcs. 1,
2) Network switch Type B - pcs. 1,
3) Type-C network switch - pcs. 1,
4) Network switch Type D - pcs. 1.
4. The exercise of the Option Right by the Ordering Party depends on the needs of the Ordering Party and on the Ordering Party having financial resources allocated for the performance of the Agreement.
5. An optional contract does not constitute an obligation of the Contracting entity to award it, nor does it constitute a basis for the Contractor to pursue claims for damages for failure to perform this contract.
6. The Contractor shall ensure a sufficient number of persons and resources to perform the contract smoothly and properly.
7. The Contracting Authority informs that any proper names given in the description of the subject of the contract are not intended to violate Article 99 of the PPL, but are only intended to specify the quality and technological expectations of the Contracting Entity. The contracting authority allows equivalent solutions provided that the same technological, performance and functional level of the subject of the contract is met. All possible proper names and trade brands contained in the SWZ and documentation have been used to specify the quality and technological expectations of the Ordering Party. The contracting authority informs that it allows the submission of tenders in which individual devices or materials listed in the tender documentation may be replaced by devices or equivalent materials. The term equivalent materials and devices shall be understood as materials guaranteeing the performance of supplies or services in accordance with the requirements of the Ordering Party and ensuring obtaining technical parameters not worse than those assumed in the tender documentation and technical specifications.
8. Equivalent products and equipment must be authorised for marketing and use in accordance with applicable law. A contractor who offers equivalent products and equipment requiring a change in its decisions will have to obtain the required decisions on behalf of the Contracting Authority as part of the performance of the contract at its own effort and expense, while guaranteeing the performance of the contract within the deadline resulting from the SWZ. The Contractor who refers to equivalent solutions described by the Contracting entity is obliged to demonstrate that the supplies/services offered by it meet the requirements specified by the Contracting Entity.
9. The Contractor is obliged to perform the contract on the terms and conditions described in the draft contract constituting Annex 10 to the SWZ.
10. Pursuant to Article 257 of the PPL, the contracting authority provides for the possibility of cancelling the procedure if the public funds which the Contracting Authority intended to allocate to finance the contract are not granted to it.
