The subject of the contract is a comprehensive supply of electricity along with the provision of distribution services to the State Water Holding Polish Waters, Regional Water Management Authority in Krakow in 2024 – area of Bielsko-Biała, Tarnów
Comprehensive delivery of electricity together with the provision of distribution services will be carried out under the conditions set out in the Energy Law Act of 10 April 1997 (Journal of Laws of 2021, item 716, as amended) and the implementing regulations to this Act.
Comprehensive supply of electricity will take place to electricity consumption points (hereinafter referred to as PPE) listed in Annex No. 2 to SWZ / No. 2 to the Agreement.
1. The subject of the contract is a comprehensive supply of electricity along with the provision of distribution services to the State Water Holding Polish Waters, Regional Water Management Authority in Krakow in 2024 – area of Bielsko – Biała, Tarnów
2. Comprehensive supply of electricity together with the provision of distribution services will be carried out under the conditions laid down in the Act of 10 April 1997. Energy Law (Journal of Laws 2021, item 716, as amended), the implementing provisions of that Act, in particular in the Regulation of the Minister Economy of 4 May 2007 on the detailed conditions of the functioning of the electricity system (OJ 2007.93.623 as amended), the current tariff for electricity distribution services of the relevant Distribution System Operator (DSO) approved by the President of the Office Energy Regulations, Traffic Instructions and Distribution Network Operations, generally applicable legal provisions and unit prices of active energy determined after the resolution of the procedure.
3. Comprehensive supply of electricity will take place to electricity consumption points (hereinafter referred to as PPE) listed in Annex No. 2 to SWZ / No. 2 to the Agreement.
4. Comprehensive energy supply will be carried out in the period from 01.01.2024 to 31.12.2024.
5. Location of energy consumption points, technical data and total, estimated electricity consumption in the period from 01.01.2024 to 31.12.2024 are included in Annex 2 to the Agreement. The demand for electricity has been determined on the basis of electricity consumption in previous years, taking into account the applicable tariffs and rates, and is only indicative, used to compare offers and does not constitute an obligation on the part of the Ordering Party to purchase energy in the given quantity. The potential Contractor is not entitled to any claim against the Ordering Party for failure to consume the expected amount of energy.
6. The unit offer price of active energy for a given tariff will result from the Assortment and Price Form constituting Annex 4 to the SWZ / Annex No. 1 to the Agreement. Due to the fact that the Ordering Party is an excise tax payer and has a concession for the production of electricity no. WEE/1707/19102/W/3/2011/MOS of 24.01.2017, valid until 31.12.2030, the price may not include excise duty and must be constant for the entire duration of the contract and change only in the event of a statutory change in the VAT rate.
7. The Contracting Authority shall have the right to notify a new electricity consumption point, however, increasing the consumption points or changing the tariff group will be possible based on the tariff groups priced in the Contractor's assortment and price form. Notification of a new PPE will require an annex to the contract.
8. The contracting authority will have the right to reduce the number of PPE due to, for example, a change in the location (address) of RZGW or its organizational unit
9. The Ordering Party requires that the settlement for the consumed energy takes place in the settlement periods applied by the DSOs, according to actual consumption, with the payment date of invoices for the supplied electricity and distribution service specified for 30 days from the date of issuing the document.
10. Under a comprehensive agreement, the Contractor should be indicated as the entity responsible for commercial balancing, i.e. covering losses resulting from the difference in forecast energy consumption in relation to the actual one in a given settlement period and preparing and submitting electricity demand schedules to the Distribution System Operator and the Transmission System Operator.
