The subject of the contract is the service of collection and management of municipal waste from property owners residing in the Iwkowa commune, in a way that ensures the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods and reduction of the mass of biodegradable municipal waste sent to landfill, in accordance with the applicable regulations, i.e. the Act of 14 December 2012 on waste, the Act of 13 September 1996 on maintaining cleanliness and order in the municipalities (executive regulations to the above-mentioned acts) and resolutions of the Commune Council in Iwkowa adopted on the basis of the above-mentioned acts.
1. The subject of the contract is the service of collection and management of municipal waste from property owners residing in the Iwkowa commune, in a way that ensures the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods and reduction of the mass of biodegradable municipal waste sent to landfill, in accordance with the applicable regulations, i.e. the Act of 14 December 2012 on waste, the Act of 13 September 1996 on Maintaining Cleanliness and Order in Municipalities (executive regulations to the above-mentioned acts) and the resolutions of the Commune Council in Iwkowa adopted on the basis of the above-mentioned acts.
2. These services consist in the collection and management of municipal waste from the owners of inhabited properties located within the administrative borders of the Municipality of Iwkowa and waste from properties where there are summer houses or other real estate used for recreation and leisure purposes.
3. When carrying out the task of collecting and managing municipal waste collected from the Iwkowa Commune, the Contractor is obliged to manage the collected municipal waste in a manner consistent with the waste hierarchy referred to in Article 17 of the Waste Act of 14 December 2012 and in accordance with the applicable Provincial Waste Management Plan for the Małopolska Region.
4. The subject of the contract includes loading, transport and disposal of waste in regional installations specified in the Waste Management Plan of the Małopolska Region.
5. The detailed scope of services, the method of contract execution and the contractor's obligations are specified in the following documents:
- Appendix No. 4 to the SWZ, i.e. Description of the Subject of the Order (abbreviated as OPZ) and
- Appendix No. 3 to the Terms of Reference, i.e. the Draft Provisions of the Agreement with attachments.
6. The Contractor undertakes to perform the works in accordance with the scope and requirements indicated in the Description of the Subject of the Contract constituting Appendix No. 4 to the Terms of Reference, with the applicable regulations and standards, the current level of technical knowledge and the proposed provisions of the contract, as well as with due diligence.
7. Pursuant to Article 95(1)-(2) of the Public Procurement Law, the contracting authority requires the contractor or subcontractor to employ at least one person on the basis of an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code, to perform work in the field of vehicle maintenance (e.g. driver) or to handle ongoing notifications, prepare reports and settlements.
The detailed scope of the obligation to employ these persons under an employment contract, in particular the issues concerning the method of verification of employment of these persons and the contracting authority's right to control the contractor's compliance with the requirements related to the employment of these persons and the sanctions for failure to meet these requirements are set out in the Draft provisions of the agreement
