The subject of the contract is the purchase and delivery of 2 pcs. block arrays and 2 pcs. object arrays with maintenance service for a period of 36 months.
Part 1 of the order – purchase and delivery of 2 pcs. block arrays3.1. Sale, delivery, installation, configuration and commissioning of IT Equipment together with the Software, in accordance with the specification and ensuring the functionalities referred to in Annex 1 to the PPU constituting Annex 6.1. to the SWZ, including:
3.1.1. providing the Ordering Party - on the terms set out in the agreement and general license conditions of the Software manufacturer - the right to use (on the terms of the license) the Software, including both in whole and in its individual elements along with the right to use the documentation of the manufacturer of IT Hardware and Software (technical, user, administrator);
3.1.2. providing the Ordering Party with the right to unlimited use of the Software together with its Documentation in accordance with point 3.1.1. on a license basis, starting from the date of signing the Implementation Protocol without reservations by the Ordering Party, including the transfer of a license document issued by the manufacturer of IT Hardware and Software confirming the right to use the Software by the Ordering Party, in accordance with the provisions of the PPU and the general license terms of the manufacturer, and the content of the manufacturer's license terms and conditions of use of the Software prepared in Polish (or in English, if there is no Polish language version);
3.1.3. execution and implementation of the Implementation in accordance with the provisions of § 5 section 6 ppu;
3.1.4. conducting instructions for persons indicated by the Ordering Party, in accordance with the terms of the PPU.
3.2. Providing the Ordering Party with warranty service for IT Equipment together with the Software for a period of 36 months from the date of signing the Implementation Protocol without reservations by the Ordering Party, including providing the manufacturer's support (Service Care) by issuing an appropriate document to the Ordering Party, confirming the right to access the manufacturer's support in the above-mentioned period, in accordance with the manufacturer's general terms and conditions.
Part 2 orders – purchase and delivery of 2 pcs. object matrices4.1. Sale, delivery, installation, configuration and launch of the System, in accordance with the specification and ensuring the functionalities referred to in Annex 1 to the PPU constituting Annex 6.2. to the SWZ, including:
4.1.1. providing the Ordering Party - on the terms specified in the agreement and the general license conditions of the System manufacturer - the right to use (on the terms of the license) the System, including both in whole and its individual elements together with the right to use the documentation of the System manufacturer (technical, user, administrator);
4.1.2. providing the Ordering Party with the right to unlimited use of the Software together with its Documentation in accordance with point 4.1.1. on a license basis, starting from the date of signing the Implementation Protocol without reservations by the Ordering Party, including the transfer of a license document issued by the System manufacturer confirming the right to use the Software by the Ordering Party, in accordance with the provisions of the PPU and the manufacturer's general license conditions and drawn up in the language Polish (or in English, if there is no Polish language version) content of the manufacturer's license terms and general terms of use of the Software;
4.1.3. execution and implementation of the Implementation in accordance with the provisions of § 5 section 6 ppu;
4.1.4. conducting instructions for persons indicated by the Ordering Party, in accordance with the terms of the PPU.
4.2. Providing the Ordering Party with warranty service for the System for a period of 36 months from the date of signing the Implementation Protocol without reservations by the Ordering Party, including providing the manufacturer's support (Service Care) by issuing an appropriate document to the Ordering Party, confirming the right to access the manufacturer's support in the above-mentioned period, in accordance with the manufacturer's general terms and conditions.
