The description of the subject of the contract can be found in Appendix No. 1 to SWZ. The ordering party withdrew from the division of the order into parts due to the fact that the task includes a relatively small number of light points (approx. 4000 pcs.) covered by uniform operating rules (control, connection times). Division would cause disorganization of the lighting covered by the task and would have a negative impact on safety, extending the response time to crisis events. Failure to divide the contract into lots will not infringe the principle of fair competition and will not limit the possibility of applying for the contract by smaller entities. SME-owned contractors will have no difficulty in implementing it as a whole. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or Subcontractor to employ persons performing activities specified in the Description of the Subject of the Contract, related to the performance of which, the performance of which contains the features of the employment relationship specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320, as amended), i.e.: all works directly related to the maintenance of lighting indicated in the Description of the subject of the contract. The scope of work of persons performing the activities indicated by the Ordering Party in the scope of contract execution and the method of documenting the employment of these persons and the Ordering Party's rights to control the Contractor's compliance with the requirements and sanctions for their non-fulfillment are specified in the description of the subject of the contract (Annex No. 1 to the SWZ) and in the model contract (Annex No. 12 to the SWZ).
INFORMATION ON THE PRIOR EVALUATION OF TENDERS, IN ACCORDANCE WITH ARTICLE 139 OF THE PUBLIC PROCUREMENT LAW, IF THE CONTRACTING AUTHORITY PROVIDES FOR A REVERSED ORDER OF EVALUATION IN THIS PROCEDURE, the procedure referred to in Article 139 of the PPL Act will be applied. The contracting authority, pursuant to Article 139(1) of the PPL Act, will first examine and evaluate the tenders, and then make a subjective qualification of the Contractor whose offer has been rated the highest, in the absence of grounds for exclusion and meeting the conditions for participation in the proceedings.
The contractor whose offer has been selected is obliged to lodge a security for the proper performance of the contract in the amount of 5% of the total gross price specified in the offer. The security is used to cover claims for non-performance or improper performance of the contract
