Description:
Management of the housing stock of the Siemianowice Śląskie Commune

1. The subject of the contract is the Management of the housing stock of the Municipality of Siemianowice Śląskie, located in the Municipality of Siemianowice Śląskie being the property of the Municipality of Siemianowice Śląskie or being in the independent possession of the Municipality of Siemianowice Śląskie and being the property of the State Treasury.

2. The order item was divided into 2 parts.

2.1. Lot 1 of the contract: Management of the stock of immovable property owned or owned by the Municipality

2.2. Lot 2 of the contract: "Management of the real estate stock owned by the State Treasury".

Management of real estate owned by the Municipality or independently owned by the Municipality

1. The subject of Lot 1 of the contract is the provision of services in the field of housing stock management of the Municipality of Siemianowice Śląskie, consisting in making decisions and performing activities aimed in particular at:

1) ensuring proper economic and financial management of real estate,

2) ensuring the safety of use and proper operation of real estate,

3) day-to-day administration of the property,

4) maintenance of the property in a non-deteriorated condition in accordance with its intended purpose,

5) compliance with applicable law,

hereinafter referred to as "management services" or "management", covering a resource consisting of:

a) real estate owned by the Ordering Party, developed with residential and non-residential buildings,

b) real estate owned by the Ordering Party, developed with residential and non-residential buildings,

(c)other construction works within the meaning of the Law of 7 July 1994. Construction law, owned by the Ordering Party or owned by the Ordering Party, in particular garages, kiosks, business facilities,

d) undeveloped real estate owned by the Ordering Party or owned by the Ordering Party,

e) municipal premises in buildings of housing communities owned by the Contracting Authority, hereinafter referred to as: "managed resource".

2. Summary of the area of the managed resource:

1) real estate developed with residential buildings, owned by the Ordering Party or owned by the Ordering Party – with an area of 348 629.91 m²,

2) residential, emptied, undeveloped real estate – with an area of 1,755.61 m²

3) real estate developed with non-residential buildings, owned by the Ordering Party or owned by the Ordering Party – with an area of 5,652.56 m²,

4) real estate developed with non-residential buildings, owned by the Ordering Party or owned by the Ordering Party – empty – with an area of 306.20 m²,

5) other real estate (construction objects) within the meaning of the Construction Law owned by the Ordering Party or owned by the Ordering Party, e.g. garages, kiosks – with an area of 10,056.67 m²,

6) undeveloped real estate owned by the Ordering Party or owned by the Ordering Party – with an area of 9,021.97 m²,

7) communal premises in buildings of housing communities owned by the Ordering Party – with an area of 64 150.10 m²,

8) commercial premises in buildings of housing communities – with an area of 889.97 m²

3. Whenever the concept of area appears in this SWZ, it shall be understood as:

a) in the case of premises – usable area of the premises within the meaning of the Act of 21 June 2001 on the protection of tenants' rights, the housing stock of the municipality and amending the Civil Code,

(b) in the case of residential and non-residential buildings, the sum of the total area of the buildings and the total area of the common property,

(c) in the case of other construction works referred to in point 2.1.1.5(c) above, the surface area of the work measured by the internal length of its walls;

(d) in the case of immovable property which has not been built on, the area measured by the boundaries of that property.

4. The above surface sizes have been determined as at 01.06.2023 and constitute the basis for calculating the offer price.

Management of the property resource owned by the Treasury

1. The subject of Lot 2 of the contract is the provision of services in the field of management of residential and commercial premises in buildings of housing communities owned by the State Treasury, in a manner that guarantees:

1) ensuring proper economic and financial management of real estate,

2) ensuring the safety of use and proper operation of real estate,

3) day-to-day administration of real estate,

4) maintenance of the property in a non-deteriorated condition in accordance with its intended purpose,

5) compliance with applicable law,

hereinafter referred to as "management services" or "management", covering a stock consisting of residential and commercial premises in buildings of housing communities owned by the State Treasury.

2. Summary of the area of the managed resource:

- residential and commercial premises in buildings of housing communities owned by the State Treasury – with an area of 409.58 m2.

3. Whenever the concept of area appears in this SWZ, it shall be understood as:

a) in the case of premises – usable area of the premises within the meaning of the Act of 21 June 2001 on the protection of tenants' rights, the housing stock of the municipality and amending the Civil Code,

(b) in the case of residential and non-residential buildings, the sum of the total floor area of the buildings and the total area of the common property.

4. The above surface sizes have been determined as at 01.06.2023 and constitute the basis for calculating the offer price
