The subject of the contract is the preparation of design documentation (without the Technical Design) and obtaining on its basis a building permit for the task - the investment entitled: "Extension of the existing heating plant with a steam block with a multi-fuel boiler producing heat and electricity in high-efficiency cogeneration planned to be implemented in PEC - Gliwice Sp. z o.o. in Gliwice at 135 Królewska Tamy Street". The detailed scope of the contract and the conditions for implementation are specified in the SWZ, the description of the subject of the contract and the draft provisions of the public procurement contract.
1. The subject of the contract for the implementation of the task - the investment entitled: "Extension of the existing heating plant with a steam block with a multi-fuel boiler producing heat and electricity in high-efficiency cogeneration planned to be implemented in PEC - Gliwice Sp. z o.o. in Gliwice at 135" Królewska Tamy Street is:
a) preparation of design documentation: construction project including land development project (PZT) and architectural and construction design (PAB) and other documents necessary to obtain a building permit without a technical design and obtain a final building permit on this basis, and
b) implementation of the draft schedule for the implementation of the investment together with the determination of the estimated total investment outlay and expenditures at individual stages of the investment, and
c) preparation of a functional and utility program in accordance with the Public Procurement Law (i.e. Journal of Laws of 2021, item 1129, as amended) in order to conduct a tender procedure for the design and execution of construction works on the basis of the design documentation referred to in point 1 letter a,
d) providing in the form of: (i) making changes and modifications: design documentation or developing a functional and utility program, (ii) developing answers to contractors' questions, (iii) responding to claims and comments submitted by potential or actual contractors, (iv) responding to comments or claims of contractors regarding defects in design documentation along with submitting their position to the Ordering Party with justification, and
e) transfer to the Ordering Party of proprietary copyrights to design documentation and development of a functional and utility program and transfer of proprietary copyrights to changes and modifications of these works and transfer to the Ordering Party of derivative rights to all works made by the Contractor as part of the implementation of the subject of the contract in the field of exploitation described in the model contract constituting Annex 8 to the SWZ.
2. The design documentation and the functional and utility programme covered by the contract shall include the extension of the existing heating plant with a steam unit with a multi-fuel boiler generating heat and electricity in high-efficiency cogeneration in accordance with applicable regulations.
3. The scope of work shall include all work and activities necessary for the performance of the task, including the following elements:
• development of a construction project including a Land Development Project and an Architectural and Construction Design (without a Technical Design) with the required arrangements, decisions and permits along with obtaining the final decision of the building permit. The development of design documentation must take into account the location of the project indicated by the Contracting Authority according to the variant from the concept for which the decision on environmental conditions was obtained (final, not final and which has been appealed).
• preparation of requests for opinions, arrangements, permits, decisions,
obtaining opinions, arrangements, permits, decisions and derogations (if it is necessary to obtain derogations),
• execution of unmentioned design studies, and related to the requirements of the issuing entities, but not going beyond the subject of the contract,
• preparation of a draft schedule for the implementation of the investment along with the development of a list of capital expenditures with a breakdown into individual stages of investment implementation,
• development of a functional and utility program in accordance with the Public Procurement Law (i.e. Journal of Laws of 2021, item 1129, as amended), in order to conduct a tender procedure for the design and execution of construction works on the basis of the design documentation referred to in point 1 point 1 of the Article 1(a),
4. Acting in the name and on behalf of the Ordering Party before all offices concerning this contract.
