Delivery of a gaseous nitrogen generation unit with a trailer for its transport and training of persons in its operation

1. The subject of the contract is the delivery of a brand new, from the production of 2022/2023 equipment for the production of nitrogen in a gaseous state together with a trailer for its transport and with training of people in the scope of its operation, hereinafter referred to as "products" in the assortment and quantities specified in the Price Form constituting Annex 1 to the SWZ along with training of people in its use, handling and performing basic, uncomplicated repairs. Products constituting the subject of the order should be manufactured in accordance with

with current technical documentation of their production and meet the technical requirements set out in Annex 2 to the Draft provisions of the contract. In addition, the Contractor shall provide the Technical Documentation referred to in § 8 of the Draft provisions of the contract.

2. The Contractor, at its own expense, shall conduct theoretical and practical training of persons designated by the Recipients in the amount of up to 10 people in the field of operation and service.

The training will be carried out on the basis of a training program developed by the Contractor, agreed by him with the Head of Aviation Technology of the Armed Forces Support Inspectorate (STL IWsp SZ), Dwernickiego 1, 85-915 Bydgoszcz no later than one week before handing over the device to the Recipient. The condition for accepting the product is to conduct training completed with the issuance of individual certificates entitling to use the product.

3. The Contractor shall provide a guarantee for the subject of the contract in the amount of not less than 24 months, counting from the date of signing the acceptance-handover protocol by the representatives of the Contractor and representatives of the Recipient.

4. The customer requires at least 1 service point in the Polish.

5. The Contractor's quality management system should meet the requirements of

in PN:EN ISO 9001:2015.

6. The subject of the contract will be subject to military acceptance by the Regional Military Representation (RPW) on the terms set out in this SWZ.

7. At the same time, the Contractor together with the products shall provide the OiB declaration of conformity issued in accordance with the Act of 17 November 2006 on the conformity assessment system of products intended for the needs of defense and state security (Journal of Laws

of 2022, item 747, as amended) and indicated in the Regulation of the Minister of National Defense

of 11 January 2013 on the detailed list of products subject to conformity assessment and the method and procedure for conducting conformity assessment of products intended for the needs of state defense (Journal of Laws of 2021, item 1628, as amended) -

i.e. in mode I conformity assessment.

8. Products should meet the quality requirements specified in the manufacturer's technical documentation for the product.

9. The requirements of AQAP 2110 ed. D version 1

10. The condition for meeting the technical requirements of the offered products is to meet the operational and technical requirements set out in Annex 2

to the Draft provisions of the Agreement.

11. The Contractor is obliged to indicate in the Price Form constituting Annex 1 to the SWZ in box 2 the NSN number or the P / N number and in box 5 the names of the offered products, their types / model and manufacturer

12. The contracting authority requests that the offer be accompanied by the means of proof indicated in Chapter IV of the SWZ, confirming that the proposed products meet the requirement set out in point 10.

13. The Contractor is obliged to provide the Recipient and the Contracting entity with the Technical Documentation referred to in § 8 of the Draft provisions of the contract,

in the following scope:

a) security – agreed with STL IWsp SZ:

Maintenance Manual (IOT);

b) production – agreed with RPW:

Technical Conditions (WT);

c) use – agreed with STL IWsp SZ, which includes:

Instructions for Use (IU);

Book Devices (KU).

14. The contracting authority does not provide for the possibility of exercising the option right.

15. Detailed conditions for the performance of the contract are set out in the Draft provisions of the contract constituting Annex 2 to the SWZ.

16. Pursuant to Article 455 of the PPL, the contracting authority allows for the possibility of amending the contract

without conducting a new procurement procedure in the cases of

and under the conditions specified in § 19 of the Draft provisions of the contract constituting Annex 2 to SWZ.

17. The award of the contract does not involve making classified information available to the Contractor.

18. Designation of the subject of the contract according to the Common Procurement Vocabulary – CPV code: 42980000-9 – Gas generators.

19. Pursuant to Article 134(2) of the PPL, the Contracting Authority informs that:

a) it does not allow partial bids to be submitted;

b) does not allow variants to be submitted;

c) does not provide for the conclusion of a framework agreement;

d) does not provide for the possibility of awarding contracts referred to in Article 214(1)

points 7 and 8 of the PPL;

e) does not provide for the Contractor to carry out an on-site inspection or check the documents necessary to perform the contract referred to

in Article 131(2) of the PPL;

f) does not provide for settlement between the Contracting Authority and the Contractor in foreign currencies;

g) does not provide for the prior evaluation of bids referred to in Article 139 of the PPL;

h) does not provide for an electronic auction;

i) does not provide for reimbursement of the costs of participation in the proceedings;

j) does not require Contractors to be employed on the basis of an employment relationship referred to in Article 95 of the PPL;

k) does not require Contractors to employ persons referred to in Article 96(2)(2) of the PPL;

l) does not reserve the right to apply for the award of the contract only by the Contractors referred to in Article 94 of the PPL;

m) does not reserve the obligation of the Contractor to perform key tasks personally;

n) does not provide for the possibility of submitting offers in the form of electronic catalogues

or attaching electronic catalogues to the offer.
