1. The subject of the order is the delivery of the license and subscription of Microsoft software to the Authority
Cities of Krakow under the terms specified in the Microsoft Product and Services Agreement (known as
hereinafter agreement MPSA) No 4100013999 (for local government units) concluded between Microsoft
Ireland Operations Limited B. V. and Ministry of Digitisation by Microsoft Contractor
Licensing Solution Providers (LSP).
2. A detailed description of the subject of the contract shall include the model contract, annex 6 to the SWZ.
1. The subject of the order is the delivery of the license and subscription of Microsoft software to the City Office
Krakow under the terms specified in Microsoft Product and Services Agreement No 4100013999
(for local government units) concluded between Microsoft Ireland Operations Limited B. V. and
The Ministry of Digitization by the Contractor holding the status of Microsoft Licensing Solution Providers (LSP).
2. A detailed description of the subject of the contract shall include the model contract, annex 6 to the SWZ.
3. The Contracting Authority does not require the execution of the contract by protected labor establishments, social cooperatives, or
other contractors covered by the provision of Article 94 (1) of the Public Procurement Law Act, known as
further “the bill”.
4. The Contracting Authority does not require employment of persons on the basis of employment.
5. The Contracting Authority does not provide for the possibility of awarding contracts referred to in point 8 of Article 214 (1) of the Act.
6. The Contracting Authority did not conduct preliminary market consultations prior to the initiation of the procedure.
7. The Contracting Authority allows the possibility of executing the subject of the contract by the Contractor using
subcontractors under the rules laid down in the SWZ.
8. The procedure referred to in Article 132 of the Act shall be followed in the present proceedings and therefore the mode
unlimited tender. The Contracting Authority shall apply a prior assessment of tenders in accordance with Article 139 of the Act.
9. The entry in Section II.2.7 shall read: The subject of the contract shall be executed for a period of 16 months from the date of conclusion of the contract or until the amount referred to in § 6 (1) of the contract formula is exhausted.
10. Justification for the application of the price quotation evaluation criterion — 100% The only criterion for evaluating the offer is the price criterion because the seller of the Microsoft license and subscriptions, executes delivery according to the standards arising from the terms of Microsoft Product and Services Agreement (MPSA) No. 4100013999 (for local government units) concluded between Microsoft Ireland Operations Limited B. V. and the Ministry of Digitisation. The description of the subject of the order contains the requirements of the Purchasing Authority as to the quality of the sales that each tenderer is expected to meet and the cost of the software license (which is the subject of the order) is due to the Microsoft price list. With regard to the delivery path, the only criterion is the cost associated with sales by the seller who has the status of Microsoft Licensing Solution Providers — LSP.
The qualitative requirements referred to in Article 246 (2) of the Act, the Contracting Authority described in detail in §1, 3 and 5 of the model contract.
