The subject of the contract is the purchase and delivery of 12 electric buses.
1. The subject of the contract is the purchase and delivery of 12 electric buses.
2. The subject of the order includes:
1) purchase and delivery to the place indicated by the Ordering Party of 12 brand new units, i.e. manufactured no later than 12 months before delivery, unused, low-floor, single-unit electric buses (powered by 100% electricity) of standard class (12-meter), hereinafter referred to as EV buses (Electric Vehicle), equipped with completion in accordance with the specification of the terms of the contract (OPZ), adapted to the transport of disabled people with additional equipment, software and documentation,
2) delivery of special tools, diagnostic and control and measurement instruments, instrumentation, programs for performing maintenance and repair works,
3) delivery of programs and additional devices along with assembly costs, as well as the required documentation,
4) conduct the necessary training and authorization to perform technical maintenance and warranty repairs of delivered buses.
3. The description of the subject of the contract (OPZ) is included in Annex 9 to the SWZ (Annex 2 to the Agreement).
4. Framework requirements for warranty, service, authorization, training, documentation and software are included in Annex 10 to the SWZ (Annex 3 to the Agreement).
5. All costs related to the implementation of the subject of the contract, including, among others, acceptance, delivery, vehicle tests, inspections, motor insurance for the period of transport, remuneration of drivers designated for transport, etc., shall be borne by the Contractor.
6. If, in connection with the performance of works constituting the subject of the contract, an obligation to pay any administrative or stamp fee arises, the Contractor undertakes to pay it to the competent office within the time limit specified in the applicable provisions of law.
7. Wherever the subject of the contract is described by indicating trademarks, patents or origin, source or a specific process that characterizes products or services provided by a specific Contractor, if this could lead to the privilege or elimination of some Contractors, the Contracting Authority shall allow the Contractor to use solutions equivalent to those described in the OPZ, provided that they have, at least the same or better technical and functional parameters and will not lower all the standards set out in the OPZ.
8. If the Contractor proposes materials and other equivalent elements, it is obliged to prepare and attach to the tender a list of all proposed materials and other equivalent elements and demonstrate their equivalence in relation to materials and other elements described in the OPZ, indicating the name, page and item to which they relate. The description of the proposed equivalent solutions must be sufficiently detailed so that the Contracting Authority, when evaluating the tender, can confirm that the requirements regarding their technical parameters are met and decide whether the proposed solutions are equivalent. This means that the Contractor is obliged to demonstrate that the materials and other elements offered by him are equivalent to those described by the Contracting Authority.
9. The use of materials and other equivalent elements by the Contractor may not cause any changes in the functional layout and technical and functional parameters of the subject of the contract.
