1. The subject of the contract is "Collection, export and management of waste from the area of the City and the Municipality of Muszyna". 2. The Contracting Authority allows the possibility of submitting partial tenders for individual tasks: A. TASK NO. 1 PLASTICS – COLLECTION, EXPORT AND DISPOSAL OF WASTE B. TASK NO. 2 MIXED WASTE – COLLECTION, EXPORT AND DISPOSAL OF WASTE C. TASK NO. 3 BULKY WASTE – COLLECTION, EXPORT AND DISPOSAL OF WASTE D. TASK NO. 4 EXPIRED MEDICINES – COLLECTION, EXPORT AND DISPOSAL OF WASTE E. TASK NO. 5 BIODEGRADABLE WASTE – COLLECTION, EXPORT AND DISPOSAL OF WASTE F. TASK NO. 6 USED WASTE TIRES – COLLECTION, EXPORT AND DISPOSAL OF WASTE A detailed description of the subject of the contract can be found in Chapter IV of the Specification of The Terms of Order (SWZ) and the draft contractual provisions, constituting Annex 8 to the SWZ.
TASK NO 1 PLASTICS — COLLECTION, EXPORT AND DISPOSAL OF WASTE1) The subject of the contract includes the provision of the service of collection, export and disposal of plastic waste from separate collection in the amount of approx. 303 Mg (tons), in accordance with the requirements set out in the Waste Act of 14 December 2012 together with implementing acts. 2) As part of the implementation of the subject of the contract, the Contractor is obliged in particular to: a) deliver to the designated place in the City and Spa Commune of Muszyna min. two containers with a capacity of min. 30-35 m3 for waste disposal; (b) the reception of waste classified in the waste catalogue under codes 20 01 39, 15 01 02, 15 01 05, 20 01 40, 15 01 04; (c) the successive take-over of two filled containers, in place of the containers containing waste received, leaving the same number of empty containers. The Ordering Party shall notify the Contractor by phone of the need to export waste. The collection will take place from the place designated by the Ordering Party in the City and Spa Commune of Muszyna, m.in from the Selective Municipal Waste Collection Point in Muszyna and Powroźnik, on working days during the Ordering Party's working hours, i.e. from Monday to Friday from 7:00 to 15:00. Loading works of waste into containers are performed by the Ordering Party; d) as part of the collection operation, the Contractor undertakes to remove empty containers from the cars used to transport empty containers for substitution and to load containers with waste on these cars; (e) the export and disposal of plastic waste. 3) The Contractor's duties include ensuring: a) permanent and legible marking of cars, in a visible place, company name and address data and telephone number of the Contractor; (b) protection against uncontrolled escape of waste during storage, handling and transport; (c) the design of vehicles which will protect the transported waste against dissolution and spraying and minimise the impact of atmospheric factors on the waste; d) vehicles used for waste transport that meet detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for collecting municipal waste from property owners. 4) The Ordering Party also reserves the right to deliver waste by its own transport, after prior notification of this fact to the Contractor. 5) As part of the performance of this contract, the Ordering Party provides for the possibility of exercising the right of option referred to in Article 441(1) of the Public Procurement Law, to the extent of which the Ordering Party envisages increasing the provision of the service of collection, export and disposal of waste in the amount of not more than 30% of the basic order covered by this task. 6) Both regarding the scope of the basic order and the scope of the optional order, the Ordering Party reserves the right to order services to a greater or lesser extent, as well as to increase or decrease the quantity and change the type of services depending on the needs of the Ordering Party (in relation to the quantities specified in the offer form) as part of the contractual remuneration. In the context of the basic scope of the contract, the Contracting Authority guarantees the performance of 50% of the value of this scope of the contract.
TASK NO 2 MIXED WASTE — COLLECTION, EXPORT AND DISPOSAL OF WASTE1) The subject of the contract includes the provision of a service of collection, export and disposal of unsegregated (mixed) municipal waste in the amount of approx. 2 135 Mg (tons) per mechanical-biological waste treatment installation, in accordance with the requirements set out in the Waste Act of 14 December 2012 together with implementing acts. 2) As part of the implementation of the subject of the contract, the Contractor is obliged in particular to: a) deliver to a designated place in the City and Commune of Muszyna three containers with a capacity of min. 30-35 m3 for waste disposal; (b) take-back of waste classified in the Waste Catalogue under codes 20 03 01; (c) the successive take-over of two filled containers, in place of the containers containing waste received, leaving the same number of empty containers. The Ordering Party shall notify the Contractor by phone of the need to export waste. The collection will take place from the place designated by the Ordering Party in the City and Spa Commune of Muszyna, m.in from the Selective Municipal Waste Collection Point in Muszyna and Powroźnik, on working days during the Ordering Party's working hours, i.e. from Monday to Friday from 7:00 to 15:00. Loading works of waste into containers are performed by the Ordering Party; d) The Contractor undertakes to collect and transport to the places of recovery or disposal of containers containing waste after receiving information from the manager by telephone and in the BDO system on the same day from 14.00 - 20.00. In addition, the Contractor undertakes to collect waste and transport this waste to recovery or disposal sites at each request of the Ordering Party, in the number of containers containing waste indicated in the notification; e) in such a case, the collection will take place on the same day after the notification from 14.00 to 20.00, regardless of the receipt provided for in the previous sentence; f) as part of the collection operation, the Contractor undertakes to remove empty containers for substitution from the cars used for transport and to load containers with waste on these cars; (g) the transport of waste to recovery or disposal facilities; (h) the mechanical treatment of the waste received; (i) the management of secondary raw materials from the waste received; (j) the disposal of mechanical treatment residues of the waste received. 3) The Contractor's duties include ensuring: a) permanent and legible marking of cars, in a visible place, company name and address data and telephone number of the Contractor; (b) protection against uncontrolled escape of waste during storage, handling and transport; (c) the design of vehicles which will protect the transported waste against dissolution and spraying and minimise the impact of atmospheric factors on the waste; d) vehicles used for waste transport that meet detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for collecting municipal waste from property owners. 4) As part of the performance of this contract, the Ordering Party provides for the possibility of exercising the right of option referred to in Article 441(1) of the Public Procurement Law, to the extent of which the Ordering Party envisages increasing the provision of the service of collection, export and disposal of waste in the amount of not more than 30% of the basic order covered by this task. 5) Both regarding the scope of the basic order and the scope of the optional order, the Ordering Party reserves the right to order services to a greater or lesser extent, as well as to increase or decrease the quantity and change the type of services depending on the needs of the Ordering Party (in relation to the quantities specified in the offer form) as part of the contractual remuneration. TASK NO 3 LARGE-SIZED WASTE — COLLECTION, EXPORT AND DISPOSAL OF WASTE1) The subject of the contract includes the provision of a service of receipt, export and disposal of bulky waste in the amount of approx. 312 Mg (tons), in accordance with the requirements set out in the Waste Act of 14 December 2012 together with implementing acts. 2) As part of the implementation of the subject of the contract, the Contractor is obliged in particular to: a) deliver to the designated place in the City and Spa Commune of Muszyna min. two containers with a capacity of min. 30-35 m3 for waste disposal; (b) take-back of waste classified in the Waste Catalogue under codes 20 03 07, (c) successive take-back of two filled containers, in place of the received containers containing waste, leaving the same number of empty containers. The Ordering Party shall notify the Contractor by phone of the need to export waste. Collection will take place from the place designated by the Ordering Party in the City and Spa Commune of Muszyna, m.in from the Selective Municipal Waste Collection Point in Muszyna, on working days during the Ordering Party's working hours, i.e. from Monday to Friday from 7:00 to 15:00. TASK NO 4 EXPIRED MEDICINES — COLLECTION, EXPORT AND DISPOSAL OF WASTE1) The subject of the contract includes the provision of service of specialized containers for the collection of expired medicines, collection, transport and disposal of expired medicines from pharmacies, pharmacy points located within the administrative boundaries of the Muszyna Municipality, indicated in Annex No. 9 to the SWZ. The subject of the contract includes waste classified under the codes: 20 01 32. 2) The Ordering Party reserves the right to indicate additional, other than those listed in Annex 9 to the SWZ, places of waste collection during the term of the subject of the contract, if necessary. 3) The expected amount of expired medicines to be collected during the entire duration of the order is approx. 0.4 Mg (tons). 4) Expired drugs will be collected in specialized containers for the collection of expired drugs. 5) Collection of waste from individual pharmacies, pharmacy points will take place 1 time per quarter and additionally in the event of such a need within 7 days of notification by the Ordering Party. 6) The Contractor's duties include ensuring: a) protection against uncontrolled escape of waste, during its storage, transshipment and transport; (b) vehicle design which will protect the transported waste against dilution and spraying and minimise the impact of atmospheric factors on the waste. 7) As part of the performance of this contract, the Ordering Party provides for the possibility of exercising the right of option referred to in Article 441(1) of the Public Procurement Law, to the extent of which the Ordering Party envisages increasing the provision of the service of collection, export and disposal of waste in the amount of not more than 30% of the basic order covered by this task. 8) Both regarding the scope of the basic order and the scope of the optional order, the Ordering Party reserves the right to order services to a greater or lesser extent, as well as to increase or decrease the quantity and change the type of services depending on the needs of the Ordering Party (in relation to the quantities specified in the offer form) as part of the contractual remuneration. In the context of the basic scope of the contract, the Contracting Authority guarantees the performance of 50% of the value of this scope of the contract.
TASK NO 5 BIODEGRADABLE WASTE — COLLECTION, EXPORT AND DISPOSAL OF WASTE1) The subject of the contract is the provision of a service of collection, export and disposal of biodegradable municipal waste in the amount of approx. 30 Mg (tons) to RIPOK for KOMPOSTECH installations in Nowy Sącz, in accordance with the requirements set out in the Waste Act of 14 December 2012 together with implementing acts. The subject of the contract includes waste classified under the codes: 20 02 01, 20 01 08. 2) As part of the implementation of the subject of the contract, the Contractor is obliged to: a) Collect biodegradable municipal waste from the place indicated by the Ordering Party in the City and Municipality of Muszyna, b) Export of biodegradable municipal waste by transport adapted for this purpose. c) Leaving containers for loading at the loading yard by removing them from carriers/motor vehicles. 3) Loading of biodegradable waste into containers is carried out by the Ordering Party. 4) The Ordering Party shall notify the Contractor by phone of the need to export biodegradable waste. Collection of waste will take place from the place designated by the Ordering Party in the Commune of Muszyna on working days during the Ordering Party's working hours, i.e. from Monday to Friday from 7:00 to 15:00. 5) The Contractor's duties include: a) permanent and legible marking of cars, in a visible place, company name and address data and telephone number of the Contractor; (b) protection against uncontrolled escape of waste during storage, handling and transport; (c) the design of vehicles which will protect the transported waste against dissolution and spraying and minimise the impact of atmospheric factors on the waste; d) vehicles used for waste transport that meet detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for collecting municipal waste from property owners. 6) As part of the performance of this contract, the Ordering Party provides for the possibility of exercising the right of option referred to in Article 441(1) of the Public Procurement Law, to the extent of which the Ordering Party envisages increasing the provision of the service of collection, export and disposal of waste in the amount of not more than 30% of the basic order covered by this task. 7) Both regarding the scope of the basic order and the scope of the optional order, the Ordering Party reserves the right to order services to a greater or lesser extent, as well as to increase or decrease the quantity and change the type of services depending on the needs of the Ordering Party (in relation to the quantities specified in the offer form) as part of the contractual remuneration. TASK NO 6 WASTE FUSED TYRES — COLLECTION, EXPORT AND DISPOSAL OF WASTE1) As part of the implementation of the subject of the contract, the Contractor is obliged, in particular, to collect waste used tires from the Selective Municipal Waste Collection Point in the City and Spa Commune of Muszyna. The subject of the contract includes waste classified under the codes: 16 01 03. 2) The Ordering Party orders, and the Contractor undertakes to manage in the manner referred to in paragraph 4 waste in the amount of approx. 30 Mg (tons). 3) The Contractor undertakes to deliver containers with a capacity of min. 30-35 m3 for waste disposal. Containers will be successively collected after filling. 4) As part of the implementation of the subject of the contract, the Contractor is obliged to: a) collect waste from the place indicated by the Ordering Party, referred to in paragraph 1 and transport it to recovery or disposal points. (b) Mechanical treatment of the waste received. c) Management of secondary raw materials from the waste received. (d) Disposal of residues from the mechanical treatment of the waste received. e) Placing containers for loading by the Contractor at the loading yard by removing them from carriers / motor vehicles. 5) Loading works of waste into containers are performed by the Ordering Party. 6) All costs related to the performance of services constituting the Contractor's obligation, including the costs of loading containers containing waste onto cars for transport, will be borne by the Contractor. 7) The Contractor undertakes each time collecting waste from the Selective Municipal Waste Collection Point to leave the same number of empty containers at the place of collection, in place of the collected containers containing waste. 8) As part of the collection operation, the Contractor undertakes to remove from the cars used to transport empty containers for substitution and to load containers with waste on these cars. 9) The Contractor undertakes to collect and transport to the places of recovery or disposal of containers containing waste after information that they have been filled in the shortest possible time no later than one working day from Monday to Friday inclusive, except for non-working days at the Ordering Party. Waste collection will take place from 7.00.-15.00. In addition, the Contractor undertakes to collect waste and transport this waste to recovery or disposal sites at each request of the Ordering Party, in the number of containers containing waste indicated in the notification. In this case, the collection will take place on the next day after the notification, from 7.00 to 15.00, regardless of the collection provided for in the previous sentence.
