1. The subject of the contract is the implementation of a service consisting in the collection and transport of the entire amount of municipal waste from the owners of real estate where residents live and municipal waste is generated from the area of the city and municipality of Czarne and the delivery of bags for selective waste collection in the years 2024-2026.

The subject of the contract is the implementation of a service consisting in the collection and transport of the entire amount of municipal waste from the owners of real estate where residents live and municipal waste is generated from the area of the city and municipality of Czarne and the delivery of bags for selective waste collection in the years 2024-2026.

3. SOCIAL ASPECTS. Requirements for employment based on an employment relationship, in the circumstances referred to in Article 95 of the Public Procurement Law:

1) the type of activities related to the performance of the contract, which are subject to the requirements of employment on the basis of an employment relationship by the Contractor or subcontractor of persons performing activities during the performance of the contract related to the performance of work as a driver during the term, were employed by the Contractor or subcontractor on the basis of an employment contract within the meaning of Article 22 § 1 of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2020, item 1320, as amended).

2) the method of verifying the employment of these persons: At each request of the Contracting Authority within the prescribed period, the Contractor shall submit the evidence indicated below in order to verify the employment, by the Contractor or subcontractor, on the basis of an employment contract, of persons performing the activities referred to in point 1):

(a) the statements of the employed employee;

(b) statements made by the Contractor or Subcontractor about the employment of an employee under an employment contract;

(c) certified for compliance with the original copy of the employment contract of the employed employee;

(d) other documents;

- containing information, including personal data, necessary to verify employment under an employment contract, in particular the name and surname of the employee employed, the date of conclusion of the employment contract, the type of employment contract and the scope of the employee's duties.

3) the rights of the Contracting Authority to control the Contractor's compliance with the requirements related to the employment of these persons and sanctions for failure to meet these requirements:

a) The Contracting Authority is entitled to perform control activities towards the Contractor regarding the Contractor's or subcontractor's compliance with the requirement of employment under an employment contract of persons performing the activities indicated in point 1. The Ordering Party is entitled in particular to:

- request evidence in the scope of confirming compliance with the above-mentioned requirements and their assessment

- request explanations in case of doubts regarding the confirmation of compliance with the above-mentioned requirements

- carry out on-the-spot inspections;

b) for failure by the Contractor or subcontractor to meet the requirement to employ persons performing the activities indicated in point 1 under an employment contract, the Contracting Authority provides for a sanction in the form of an obligation for the Contractor to pay a contractual penalty in the amount of PLN 5,000 (five thousand zlotys 00/100), which must be included in the contract. Failure by the Contractor to submit, within the time limit set by the Contracting Entity, the evidence requested by the Contracting entity in order to confirm that the Contractor or subcontractor meets the requirement of employment under an employment contract shall be treated as failure by the Contractor or subcontractor to meet the requirement of employment under an employment contract of persons performing the activities indicated in point 1;

c) in case of doubts as to compliance with labour law by the Contractor or subcontractor, the Contracting Authority may request an inspection by the National Labour Inspectorate.

4. The contracting authority does not require the means of proof in question in the present proceedings.

5. The contracting authority shall not divide the contract into lots for the following reasons:
