The description of the subject of the contract and its scope is included in Appendix No. 1 to SWZ – Description of the subject of the contract (OPZ).
The contracting authority does not allow the submission of partial and variant tenders, does not provide for the conclusion of a framework agreement, does not provide for the award of contracts referred to in Article 214(1)(7) and (8) of the PPL, does not provide for local inspections by Contractors or verification of documents referred to in Article 131(2)(2) of the PPL, does not provide for settlements in foreign currencies, does not provide for an electronic auction, does not provide for reimbursement of the costs of participation in the proceedings. The Ordering Party requires the Contractor to employ on the basis of an employment relationship persons performing security control and access control services in the Ordering Party's facilities and persons supervising their performance. The method of verifying the employment of these persons and the Ordering Party's right to control the Contractor's compliance with the requirements related to the employment of these persons and sanctions for non-compliance with these requirements is specified in the public procurement contract, the template of which is attached as Annex 5 to the SWZ. The Contracting Authority does not provide for the requirements referred to in Article 96 of the Public Procurement Law, does not allow the submission of tenders in the form of electronic catalogues or the attachment of electronic catalogues to the offer. The contracting authority did not divide the contract into lots due to the specificity of the contract and the place of provision of the services being the subject of the contract and the fact that the need to coordinate and supervise the activities of different contractors performing the different parts of the contract could jeopardise the proper performance of the contract and ensure the proper provision of services to airport users.
