Note on the use of the form

With effect from 01.01.2025, no public contract will be awarded. There will be no award procedure. The use of this form (compulsory form) is only for information purposes in order to publicize the administrative procedure.

The district of Wittenberg, as the licensing authority for the issuance of regular service permits, informs about the expiry of the currently existing permits pursuant to § 13 in conjunction with § 42 of the Passenger Transport Act (PBefG) for the regional line bundle on the right bank of the Elbe (line bundle 1) and the regional line bundle on the left bank of the Elbe (line bundle 2) in the area of the district of Wittenberg.

In accordance with the following criteria, the licensing authority of the district of Wittenberg carries out an approval procedure subject to administrative law for the issuance of regular service permits in accordance with the provisions of the Passenger Transport Act.

Regular service permits are to be issued with effect from 01.01.2025 for a period of 10 years.

Applications for the issuance of regular transport licences may be submitted by passenger transport undertakings within the meaning of the Passenger Transport Act in the version published on 8 August 1990 (Federal Law Gazette I p. 1690), which was last amended by Article 23 of the Act of 2 March 2023 (Federal Law Gazette 2023 I No. 56) (PBefG) in conjunction with the Ordinance on Access to the Profession for Road Passenger Transport of 15 June 2000 (Federal Law Gazette I p. 851), which was last amended by Article 24 of the Act of 2 March 2023 (Federal Law Gazette 2023 I No. 56) (PBZugV) and Council Directive 96/26/EC of 29 April 1996. Regular service licences are issued in accordance with §§ 2, 3, 8, 9, 13, 42, 44 PBefG.

Information on the administrative procedure:

1. Uniform line bundle for the district of Wittenberg

The licensing authority points out that with effect from 01.01.2025, due to the size and nature of the district and the traffic relationships, it is planned to issue the new regular service permits in a bundled manner in accordance with Section 9 (2) PBefG for the service area of the Wittenberg district. All lines of the entire service area of the district of Wittenberg will be combined into a uniform line bundle. This bundling of lines is intended to ensure that local road public transport can be provided economically, whereby the synergy effects between the lines can be exploited through an overarching exchange of vehicles, drivers (cross-line deployment) but also of passengers at the connection points.

2. Verkehrsstandards

The licensing authority points out that, according to the local transport plan of the Wittenberg district (2023-2033), transport development is to be provided by demand-based service with fixed timetable journeys and, in addition, by flexible service without timetable and line ties. The needs-based connection between fixed scheduled services in accordance with Section 42 of the PBefG and scheduled services in accordance with Section 44 of the PBefG fulfils the interests of public transport. The timetable in force at the time of this announcement, in conjunction with the supplementary service of scheduled services, corresponds to the public transport interest. Under-fulfilment as well as over-fulfilment not justified by existing transport needs is contrary to the public transport interest.
