(Numbering in accordance with SWZ): 4.1 The subject of these proceedings is the provision by the Contractor of a service consisting in the collection of municipal waste from owners of real estate located in the City of Łódź in the following sectors: Bałuty and Widzew in the period from 01.02.2023 to 30.06.2024 and in the Downtown sector in the period from 01.03.2023 to 30.06.2024.

4.2 A detailed description of the subject of the contract can be found in Annexes 1a, 1b and 1c.

4.3 The order is divided into 3 lots:

4.3.1Part 1 — Collection of communal waste from the owners of immobility. located in the city of Łódź in the Bałuty sector in the period from 01.02.2023 to 30.06.2024.

4.3.2Part 2 — Collection of communal waste owners immovable. located in the city of Łódź in the Downtown sector in the period from 01.03.2023 to 30.06.2024.

4.3.3Part 3 — Collection of communal waste from the owners of immobility. located in the city of Łódź in the Widzew sector in the period from 01.02.2023 r.do 30.06.2024

Collection of municipal waste from owners of real estate located in the city of Łódź in the Bałuty sector in the period from February 1, 2023 to June 30, 2024.

9.3.4 In order to demonstrate the absence of grounds for exclusion from progress. for the award of the contract to the Contractor, the Contracting Authority requests the following documents:

9.3.4.1 Contractors within the scope of Article 108 section 1 point 5 of the PPL, on the lack of belonging to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection (consolidated text: Journal of Laws of 2021, item 275) with another Contractor who submitted a separate offer, partial bid or statement. o belonging. to the same capital group. together with documents or information confirmation. preparation of an offer, partial offer independently of another Contractor. to the same capital group – model declaration. is Annex No. 10 to SWZ.

9.3.4.2 Statements of the Contractor on the validity of the information contained in the statement referred to:

-Article 125(1) of the PPL Act (i.e. in the single ESPD document) to the extent relating to the grounds for exclusion indicated in Article 108(1)(3)-(6) of the PPL,

-Article 5k of Regulation 833/2014 as amended by the Regulation. 2022/576 and Article 7(1) of the Act on special solutions in the field of counteracting support for aggression against Ukraine and serving to protect security. National.

The model statement is attached as Annex 6a to the SWZ. In the case of contractors jointly applying for the contract, the Contractor's statement on the validity of the information contained in the ESPD shall be submitted by each of these Contractors (also applies to partners in a civil law partnership).

In the case of reference by the Contractor to the resources of other entities, a statement on the validity of the information contained in the statement referred to in:

- Article 125(1) of the PPL Act (i.e. in the single ESPD) to the extent relating to the grounds for exclusion indicated in Article 108(1)(3)-(6) of the PPL,

- Article 5k of Regulation 833/2014 as amended by Regulation 2022/576 and Article 7(1) of the Act on special arrangements for counteracting support for aggression against Ukraine and serving to protect national security,

also submits each of these entities - specimen Annex. No. 6b to SWZ.

9.3.4.3 Information from the National Criminal Register regarding the grounds for exclusion specified in Article 108(1)(1), (2), (4) of the PPL, prepared no earlier than 6 months before its submission.

9.3.4.4 Information from the Central Register of Beneficial Owners, within the scope of Article 108(2) of the PPL, if separate regulations require entry in this register, prepared not earlier than 3 months before its submission.

4.5 Pursuant to Article 95 of the PPL, the Contracting Authority requires the Contractor or Subcontractor to employ persons on the basis of an employment relationship to perform the activities indicated by the Contracting Authority in the scope of performance of the contract, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320). i.e. the activities of an employee performing directly work related to the performance of the contract, respectively for part of the contract.

8.3.1 The Contracting Authority in relation to Contractors jointly applying for the award of the contract with regard to the condition concerning the situation of economy. or finance. and tech skills. or profession. allows for the cumulative fulfillment of the condition by the Contractors.

8.3.2 Eligibility for Progress. by Contractors jointly applying for the award of the contract will be verified by the Contracting Authority in accordance with Article 117 paragraph 2 of the PPL.

8.3.3 The condition concerning the authorization to conduct a specific activity of a host or profession, referred to in point 8.1.2.1 of the SWZ is fulfilled if at least one of the Contractors jointly applying for the award of the contract has the right to conduct a specific business or professional activity and provides services for the performance of which these rights are required.
