The subject of the contract is the supply of electricity for the Poviat Starosty in Lublin and organizational units of the Lublin Poviat for the needs of operating buildings, premises and commercial facilities. The Distribution System Operator (DSO) is PGE Dystrybucja S.A. Lublin Branch with its registered office in Lublin at 21 A Garbarska Street - an energy company licensed by the President of the Energy Regulatory Office for electricity distribution. The Supplier undertakes to sell electricity to the Ordering Party's facilities (indicated in Annex 9 to the SWZ) on the basis of a general agreement for the provision of distribution services concluded between the Contractor and the Distribution System Operator, in accordance with the Energy Law Act of 10 April 1997 (Journal of Laws of 2022, item 1385) and relevant executive acts, i.e. a concession for energy trading, issued by the President of the Energy Regulatory Office and the Act - Civil Code of 23 April 1964

The Supplier undertakes to sell electricity to the Ordering Party's facilities (indicated in Annex 9 to the SWZ) on the basis of a general agreement for the provision of distribution services concluded between the Contractor and the Distribution System Operator, in accordance with the Energy Law Act of 10 April 1997 (Journal of Laws of 2022, item 1385) and relevant executive acts, i.e. a concession for energy trading, issued by the President of the Energy Regulatory Office and the Civil Code Act of 23 April 1964 (Journal of Laws of 2022, item 1360).

The Ordering Party has agreements with DSOs for the provision of distribution services concluded in 2014 for an indefinite period.

The Ordering Party shall authorize the Supplier to carry out the procedure of changing the seller and to submit on behalf of the Ordering Party, on the basis of relevant powers of attorney, notifications of the sales contract. The current energy seller is VAT ESV GROUP, Ciepłownicza 1 A in Siechnice (contract until 30 June 2023).

The Ordering Party declares that by concluding an electricity sales agreement, it indicates the Supplier as the entity responsible for commercial balancing on the balancing market. The risk and costs associated with the imbalance of electricity shall be borne by the Supplier.

Energy supply will take place on the basis of agreements concluded separately for individual Customers listed in Annex 9 to the SWZ.

Amount allocated to finance the contract: PLN 1 437 577.

The contracting authority did not divide the order into parts. The Contracting Authority does not allow partial bids due to the specificity of the subject of the contract and the fact that the implementation of its individual parts by different Contractors would not be rational or optimal from the point of view of the financial interests of the Contracting Authority, because it could result in excessive costs of performing the contract. By conducting one tender, the Contracting Authority may obtain more favourable price conditions than by conducting a tender procedure for each entity separately.

The term of the contract – 12 months from the date of signing the contract.
