Renewal of the insurance portfolios of the city of Tournai and its ordinary agencies, the public center for social action, the Tournaisis police area and the autonomous municipal authority "Stade Luc Varenne".

This contract concerns the renewal of the insurance portfolios of the legal entities detailed above.

This market is a global market with no lots.

In accordance with Article 58 § 1 er , paragraph 2 of the law of 17.6.2016 relating to public procurement, the division into lots that may be awarded separately was considered by the contracting authority, which decided to waive it for the following reasons:

- it is in the interest of the contracting authority that one and the same contractor deals with all the services covered by the contract. Thus, the contractor has a global vision of the means put in place or to be developed to meet all of the needs;

- the statistics of the contracting authority will be analyzed as a whole by the company, with a global vision of the claims, allowing in particular the implementation of prevention plans in connection with different branches;

- the members of the staff of the contracting authority responsible for insurance must be able to clearly identify the company's account manager and the procedures to be followed in the event of a claim. It is important for staff to establish a long-term relationship of trust with this person, with an approach that is not fragmented according to the type of risk and a good general knowledge of the entire portfolio;

- claims management procedures, in particular IT, are easier to know and to apply by members of the personnel of the contracting authority if they are identical for all contracts;

- in addition, a single claim can lead to the opening of several files in different insurance branches, which would greatly complicate management in the event of different insurers;

- the contracting authority may for all these reasons make significant savings in terms of communication with its insurer and training and information for its staff.

This contract will be awarded to a single insurer who will have awarded prices for all of the following divisions:

Division 1: work accidents:

- law of 10.4.1971 on work accidents in the private sector;

- law of 3.7.1967 relating to the prevention or compensation of damage resulting from accidents at work, accidents on the way to work and occupational diseases in the public sector.

Division 2: bodily injury;

Division 3: civil liability:

- general civil liability;

- liability of agents;

- directors' liability;

- objective civil liability;

- responsibility of architects and design office;

Division 4: all risks:

- all “electronic” risks;

- all risks “work of art”;

- all “miscellaneous material” risks;

- All construction site risks;

- theft transport and stay of funds;

Division 5: fire;

Division 6: automobile:

- automobile;

- omnium missions;

Division 7: assistance to people and vehicles:

- assistance abroad;

- vehicle assistance.

The market forms an indivisible whole in such a way that the right of termination if it is exercised cannot be divided by division and will apply to the entire market.

The contracting authority reserves the right, in accordance with Article 42 § 1 er , 2º of the law of 17.6.2016, to order new services during the execution consisting in the repetition of similar services.
