The subject of the contract is the comprehensive provision of the service of collection, transport and management of municipal waste from the owners of real estate located in the Municipality of Sianów, where the residents live, in the period from 01.01.2024 to 31.12.2024, including the operation of the Selective Municipal Waste Collection Point and equipping all owners of multi-family properties with municipal waste containers and owners of single-family properties with containers for unsorted (mixed) municipal waste and in bags for segregated municipal waste.

I. DESCRIPTION OF THE SUBJECT OF THE CONTRACT

1. The subject of the contract is the comprehensive provision of the service of collection, transport and management of municipal waste from the owners of real estate located in the Municipality of Sianów, where residents live, in the period from 01.01.2024 to 31.12.2024, including the operation of the Selective Municipal Waste Collection Point and equipping all owners of multi-family properties with municipal waste containers and owners of single-family properties with containers for non-segregated (mixed) municipal waste and in bags for segregated municipal waste. The provisions of the Terms of Use and the agreement concluded as a result of these proceedings will be in force from the date of its conclusion, while the provision of waste collection, transport and management services will commence from 1 January 2024.

2. The scope of the contract includes the collection, transport and management of the entire municipal waste stream in a way that ensures the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods and the reduction of the mass of biodegradable municipal waste sent to landfill as part of the entrusted task in accordance with the current legal regulations.

3. The Contractor's duties shall include in particular:

- equipping, free of charge and at its own expense, real estate registered by the Ordering Party in single-family and multi-family buildings with the necessary containers (containers) for the collection of mixed waste, as well as collection of containers after the end of the contract;

- equipping, free of charge and at its own expense, real estate registered by the Ordering Party in single-family buildings with bags for selective collection of municipal waste, and in multi-family buildings with containers for selective collection of municipal waste, as well as collection of containers after the end of the contract;

- creating, equipping and operating at least one stationary Selective Municipal Waste Collection Point (PSZOK) located in the Sianów Commune, in accordance with the applicable regulations, ensuring its operation and the collection and management of municipal waste brought by residents to PSZOK;

- collection and management of bulky waste, waste electronic and electrical equipment and waste tires during drive-by collections.

4. The Contracting Authority provides for the possibility of awarding a contract consisting in the repetition of similar services or construction works referred to in Article 214(1)(7) of the Public Procurement Law up to the amount of 20% of the basic contract.

5. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires the Contractor and/or Subcontractor to employ persons performing activities during the performance of the contract, i.e.:

a) technical and administrative staff responsible for receiving and handling complaints related to the lack of waste collection, in accordance with the schedule,

b) drivers of vehicles intended for the collection and disposal of municipal waste,

(c) persons responsible for loading and unloading the waste collected onto vehicles intended for that purpose (loaders).
