Training and environmental data subscription services were considered as an immanent part of the product (SARMAP software, purchased partially under EC FWC SIDE II as a result of a separate procurement procedure) and have also been identified by the contracting authority as essential services for the entire package, however due to the character of these two services and the contractual limitations of the quoted EC FWC, these could not be purchased under SIDE II due to the a.m. framework contract’s requirements construction. Therefore, in order to safe the complementary character of the purchased SARMAP software package, the relevant purchase of these services corresponding to the already partially ordered SARMAP software was possible to be obtained only from the same contractor, which was subject of parallel procedure, i.e. Bechtle Brussels NV.
