Justification for shortening the deadline for submission of tenders.

Pursuant to Article 138(2)(2) of the PPL, the Contracting Authority may set a deadline for submission of tenders shorter than the deadline specified in Article 138(2), but not shorter than 15 days m.in. if there is an urgent need to award the contract and shortening the deadline for submitting tenders is justified. The above provision is the result of the implementation of the provisions of Directive 2014/24/EU. Recital 46 in the preamble to the Directive states: Contracting authorities should be allowed to shorten certain time limits applicable in open and restricted procedures and in competitive procedures with negotiation in cases where the time limits in question would be impracticable for reasons of urgency which should be duly justified by the contracting authority. It should be clarified that this need not be an exceptional urgency brought about by circumstances which cannot be foreseen by the contracting authority and which cannot be attributed to it. Thus, this means that the state of urgent necessity may also be culpable

by the contracting authority and this does not deprive it of the right to apply a shortening of the time limit. Therefore, the state of urgent necessity will include a situation in which the contracting authority should urgently take action aimed at performing a public contract. The state of urgent necessity does not mean that an immediate response is required, e.g. to remove a failure

or disaster. Shortening the minimum deadline for submitting tenders will be possible if the contracting authority is obliged to protect an interest that may be prejudiced if it waits too long for the tender to be completed.

The current contracts for "Winter and summer, manual and mechanical cleaning of public road lanes" and "Summer, manual and mechanical cleaning of internal road lanes and undeveloped municipal areas" are valid until August 31

2023 and were concluded pursuant to Article 213 and Article 214(1)(5) of the Act of 11 September 2019 – Public Procurement Law, i.e. a single-source contract.

The new Strategy of cleanliness and order in the City assumes the separation of road cleaning from other elements of the road lane, i.e. sidewalks, bicycle paths, lawns, underground passages, public transport stops, etc. and from undeveloped communal areas. It is not possible to implement the assumptions of the Strategy without completing the ongoing proceedings at the same time with their simultaneous division into two separate orders, i.e.
