Description:
Collection and transport of municipal waste from owners of real estate inhabited and uninhabited in the Ecological Association of Municipalities "Działdowszczyzna" within sector II Lidzbark

The subject of the procedure is the award of a contract for the collection and transport of municipal waste from owners of inhabited real estate and owners of uninhabited real estate and their transport to the indicated Municipal Installations of the Ecological Association of Municipalities "Działdowszczyzna". Collection of municipal waste from the property, including separately collected:

(a) paper,

(b) metals,

(c) plastics,

(d) glass,

e) multi-material packaging,

(f) biowaste,

(g) ashes from household hearths,

h) unsegregated (mixed) municipal waste,

(i) consumed electrical and electronic equipment,

(j) bulky waste.

A detailed description of the subject of the contract is Annex 1 to SWZ.

The subject of the contract includes:

1) Unsegregated (mixed) municipal waste and ash from household hearths will be collected in containers. Containers will be provided by the property owner and placed in front of the property or gazebos/garbage boxes. Waste collected in containers will be made available for collection, in accordance with the approved schedule for the Sector.

2) Separate collection of municipal waste in the Sector will take place from containers/ bags. Bags for separate collection will be provided by the Contractor at its own expense. Bags for exchange to owners of single-family properties and owners of summer plots will be delivered on a bag-for-bag basis.

3) Equipping, during the term of the contract, successively with bags for the collection of glass, plastics and metals, paper and bio-waste for each inhabited property and the property on which the summer house or other recreational and leisure property is located, used for part of the year in accordance with the annex to the Detailed Description of the Subject of the Order.

4) Delivery of waste collection schedules, agreed with the Ordering Party directly to each inhabited and uninhabited property.

5) Cleaning of waste collection sites if necessary after their collection.

6) When providing municipal waste collection services, the Contractor should comply with the principles of the Environmental Protection Law, the Act on maintaining cleanliness and order in municipalities, the Waste Act and executive acts.

7) In the scope of maintaining the proper sanitary condition of vehicles, the Contractor shall ensure that:

(a)the vehicles are maintained in a satisfactory technical and sanitary condition;

(b)the vehicles are protected against uncontrolled escape from the outside of the waste during loading and transport.

(c)the vehicles are washed and disinfected with a frequency that guarantees their proper sanitary condition, at least once a month and at least once every 2 weeks during the summer;

(d)the entity collecting municipal waste from property owners has up-to-date documents confirming the performance of the activities referred to in point (c);

e) at the end of each working day, the vehicles were emptied of waste and were parked only at the storage and transport base.

8) The Contractor is obliged to provide the owners of the property with promotional and information materials (leaflets, etc.) regarding the functioning of the waste management system in the Association, provided by the Ordering Party if necessary.

9) The Contractor is obliged to submit, within 7 days after the end of the month, monthly reports on the amount of collected unsegregated (mixed) municipal waste, the amount of bio-waste, ashes and the amount of collected segregated waste.

10) The Contractor is obliged to provide reports which properties do not comply with the obligation to separately collect waste together with documentation confirming this fact.

11) It is forbidden for the contractor to mix separately collected municipal waste with mixed municipal waste collected from property owners, as well as to mix individual fractions separately collected among themselves.

(12) It is prohibited for a contractor to mix municipal waste collected from property owners in Sector I with waste generated in other sectors.

(13) Employment requirements on the basis of the employment relationship, in the circumstances referred to in Article 95. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires that persons directly participating in the performance of the contract, i.e.: coordinator, loader, driver of categories B and C, whose performance consists in performing work in the manner specified in Article 22 § 1) of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320, as amended), were performed by persons employed by the Contractor on the basis of an employment relationship.
