The contracting entity wishes to enter into a binding framework agreement with three (3) suppliers. Binding means that the Ordering Entity is obliged to use the Framework Agreement if the Ordering Entity needs delivery of the products covered by the Framework Agreement. The three (3) suppliers are ranked on the basis of the award criterion "Best price-quality ratio", cf. clause 3.3 of the tender specifications, where the supplier with the highest points is ranked no. 1, the supplier with the next highest points is ranked no. 2 and so on.
If the highest ranked supplier assesses that it cannot deliver a specific order according to the Ordering Entity's order and in accordance with the provisions of the Framework Agreement, including but not limited to delivery time, the next highest ranked supplier on the Framework Agreement will be awarded the task and so on.
The Framework Agreement runs for four (4) years with the option to terminate the Framework Agreement after two (2) years.
Throughout the Framework Agreement period, award will be made after direct award, cf. section 99 of the Danish Public Procurement Act. However, after two (2) years of the Framework Agreement, mini-tenders will be conducted among the three (3) suppliers on the Agreement, cf. Section 100 of the Danish Public Procurement Act, whereby suppliers are re-ranked, cf. the above method of ranking.
The total volume for the Framework Agreement period is estimated at DKK 10,000,000, where stoves, built-in ovens and hobs are estimated at DKK 6,500,000, and where refrigerators, refrigerators and freezers are estimated at DKK 3,500,000. The volume is purely indicative and based on historical figures, which is why they cannot be taken as an expression of a guaranteed future turnover size.
Due to uncertainty in the estimates and the unpredictable element in relation to the remaining lifetime of existing appliances, the actual consumption and thus the maximum value of the framework agreement can be up to 30% higher than the estimated volume.
The detailed estimates for the number of individual products per year can be found in the Framework Agreement Appendix 3 – Offer List. The estimated volumes are purely indicative and are based on historical figures and expectations for continuous replacement, respectively, which is why they cannot be taken as an expression of a guaranteed future turnover size.
