The subject of the contract is a service consisting in the performance of the duties of the Substitute Investor in the scope of supervision over the implementation of the investment entitled "Reconstruction, superstructure and conservation renovation along with a change in the use of buildings located at 24 Ogrodowa Street in Łódź" and settlement of the above-mentioned investments in material and financial terms. A detailed description is included in Annex 8 to the SWZ – Description of the Subject of the Order and Annex 9 to the SWZ – Draft Agreement.
The subject of the contract is a service consisting in the performance of the duties of the Substitute Investor in the scope of supervision over the implementation of the investment entitled "Reconstruction, superstructure and conservation renovation along with a change in the use of buildings located at 24 Ogrodowa Street in Łódź" and settlement of the above-mentioned investments in material and financial terms.
The scope of the contract includes three stages:
Stage I – Comprehensive investor's supervision over: the implementation of the Investment, in the part concerning the basic contract carried out by the Contractor (specified in the OPZ) and over the author's supervision,
Stage II – Comprehensive investor's supervision over the implementation of the Investment, in the part concerning individual tasks under the right of option (specified in § 6 section 3 point 2) of the draft contract), construction works carried out by the Contractor (after submitting a declaration of will by the Contracting Authority on exercising the right of option in the scope of a given task).
Stage III – Settlement of Investments in material and financial terms. This stage is considered completed with the signing of the final acceptance protocol of the subject of the contract, which is tantamount to the performance of the subject of the contract and recognition by the Ordering Party as properly performed.
The scope of the contract will be divided into:
1) basic contract (Stages I and III), i.e. investor's supervision over the investment (carried out by the Contractor of construction works), the subject of which is:
a) reconstruction, superstructure and conservation renovation along with the change of use of the existing multi-family residential building into a residential, service-office building and a hostel (in the part necessary to obtain a permit to use the building),
b) strengthening the structure of existing foundations of buildings located at Ogrodowa 24 in Łódź on plots 2/3, 1/11 and 29/6 within S-1,
c) construction of a technical and economic building with transformer station and internal installations,
d) demolition of two farm buildings,
e) as part of works in the yard: reconstruction of hardening, new plantings (excluding the implementation of green walls), construction of small architecture,
f) reconstruction and construction of external sewerage, electricity, water and central heating installations, necessary for the functioning of the facilities, in accordance with its intended purpose,
g) delivery of the necessary equipment together with their installation and commissioning (in the part necessary to obtain a permit to use the building),
h) notifying the construction supervision authorities about the completion of construction and obtaining a decision on the occupancy permit for the entire investment,
and settlement of the Investment in material and financial terms (together with the exercise of the option right).
2) the right of option (Stage II), under which investor's supervision over the finishing of the above-mentioned building and the implementation of green walls is provided, divided into tasks:
a) supervision over the finishing of the residential part of a residential, service and office building,
b) supervision over the finishing of the hostel part of the residential, service and office building,
c) supervision over the finishing of the office part of the residential, service and office building,
d) supervision over the finishing of commercial and catering premises of a residential, service and office building,
e) supervision over the finishing of the common parts of the residential, service and office building,
f) supervision over the implementation of green walls as part of land development.
3. Pursuant to Article 95(1) of the PPL, the Contracting Authority requires employment by the Contractor, subcontractor or further subcontractor on the basis of an employment relationship, within the meaning of the Act of 26.06.1974. - Labour Code (Journal of Laws of 2022, item 1510, as amended), persons performing the following types of activities related to the performance of the contract:
- investment settlement.
The above requirement also applies to Subcontractors and further Subcontractors who will implement the Subject of the Agreement.
The subject of the contract should be performed in accordance with the Description of the Subject of the Contract, constituting Annex No. 8 to the SWZ and the provisions of the draft contract contained in Annex 9 to the SWZ
