1.1 Collection and management of municipal waste from the area of the Mszana Commune in the period from January 1, 2023 to December 31, 2023:

a) from real estate on which residents live,

b) collected at the Selective Municipal Waste Collection Point and at the Municipal Hazardous Waste Collection Point.

1.2 Supply of LDPE bags for separate collection of municipal waste and containers for collecting ash.

1.3 Organization, maintenance and operation of the Selective Municipal Waste Collection Point.

1.4 Organization, maintenance and operation of the Municipal Hazardous Waste Collection Point.

In view of the subject matter of the contract, Article 100 (1) of the Pzp Act does not apply in this proceeding.

A detailed description of the item of the order is set out in Annex 2 to Sz.

The subject of the contract includes, among others:

1. Collection and management of municipal waste from the area of the Mszana Commune during the

from 1 January 2023 to 31 December 2023:

- from the properties on which the inhabitants reside,

- collected at the Selective Collections Point of Municipal Waste and at the Communal Dangerous Waste Collections Point.

2. Supplying property owners with LDPE bags for separate collection of municipal waste, and containers for collecting ash.

3. Organization, maintenance and operation of the Selective Municipal Waste Collection Point.

4. Organization, maintenance and operation of the Municipal Hazardous Waste Collection Point.

5. In view of the subject-matter of the contract, the provision of Article 100(1) of the PPL Act does not apply in the present proceedings.

6.1 Pursuant to Article 95 of the PPL Act, the Contracting Authority requires the contractor or subcontractor to employ persons performing all activities directly related to the performance of works, i.e. manual workers participating in the performance of the contract – m.in drivers, loaders.

6.2 The method of confirming the fulfillment of the employment requirement under the employment contract by the Contractor or subcontractor of persons performing the activities indicated in point 2.1 during the performance of the contract and the Ordering Party's rights to control the Contractor's compliance with the above requirements, as well as sanctions for failure to meet these requirements are described in § 4 of Annex 1 to swz - the proposed provisions of the public procurement contract.

6.3 The Ordering Party does not specify the requirements referred to in Article 96(2)(2) of the PPL Act.

7. In accordance with Article 246(2) of the Law, the PPL specified in the description of the subject of the contract the quality requirements relating to the main elements constituting the subject of the contract, which are:

The contracting authority provides for the award of the contract pursuant to Article 214(1)(7) of the PPL Act, consisting in the repetition of similar services and will be consistent with the subject of the basic contract. The Contracting Authority provides that the value of these services may amount to a maximum of 30% of the value of the basic contract. The conditions for the award of such a contract are set out in detail in point 15 of Chapter I swz.

9. A detailed description of the subject of the contract is provided for in Annex 2.
