As a client, CBB awards the contract as a service by means of a negotiated procedure with an upstream competition for participation. In this context, CBB intends to procure the entire consumption of electrical energy in the form of schedule deliveries on the basis of the framework agreement advertised here. On the basis of the framework agreement, partial quantities of the timetable are procured at any time. The total amount of electrical energy consumed by CBB amounts to approx. 20,000 MWh per year. There are currently 2 acceptance points.
2 Subject of contract
CBB intends to purchase the entire consumption of electrical energy in the form of schedule deliveries on the basis of the framework agreement advertised here.
On the basis of the framework agreement, partial quantities of the timetable are procured at any time.
The total amount of electrical energy consumed by CBB amounts to approx. 20,000 MWh per year. There are currently 2 acceptance points.
2.1 Subject of the framework agreement
CBB intends to conclude a framework agreement with several bidders for the supply of electrical energy. The number of bidders with whom a framework agreement is concluded is not limited. All bidders who comply with the minimum requirements formulated can conclude a framework agreement with CBB.
The contractor's services are called up by CBB in the form of individual orders. Each individual assignment is made on the basis of the concluded framework agreement.
2.2 Type and scope of individual orders
Based on the tendered framework agreement, CBB issues individual orders for partial quantities of the demand for electrical energy.
All individual orders are based on a fixed schedule. The individual orders relate to the supply of electrical energy for the calendar years 2023, 2024 or 2025. For the years 2023, 2024 and 2025, the current timetables are set out as an annex to the framework agreement.
Should CBB have findings that lead to an adjustment of the 2023, 2024 and 2025 timetables, the timetables will be updated accordingly. The contractual partners will be informed in good time of the schedule that is still open for individual orders.
In the event of a contract extension for the years 2026, 2027 and 2028, the timetables will be communicated in good time. A later update is also possible for 2026, 2027 and 2028.
The delivery quantity agreed for a single order relates to a partial percentage of the corresponding schedule. Delivery year and partial percentage of the schedule are determined with the individual order. It is important to ensure that the partial quantities are rounded accordingly to a full ten kilowatts.
With individual orders, the price for the delivery of the timetable is determined. CBB will request delivery prices from companies with which a framework agreement has been entered into. The order for delivery is made to the company with the most favorable price offer.
CBB will independently regulate the processes associated with overall network use with the corresponding grid operators. Balancing and settlement of balancing energy, including EEG and electricity tax settlement, is carried out by a separate service provider.
Corresponding costs are not to be included in the prices to be offered.
2.3 Ordering individual deliveries
The framework agreement for schedule delivery is part of this tender and is the basis for ordering individual deliveries. It is attached to the draft documents as Annex 3.
2.3.1 Sequence of ordering individual deliveries
The ordering process is structured as follows:
CBB will, through a contracted service provider, request companies with which a framework agreement has been concluded to submit a price offer in due course, taking into account the general market development of electricity prices. The contracted service provider will send the companies a corresponding e-mail in due course in accordance with the schedule set out below with the request to submit the price offer.
The following flow chart therefore results
• Call by CBB via the contracted service provider to submit the offer: by e-mail on weekdays until 10:00
• Deadline: the same working day until 14:00
• Decision on the supplement: the same working day at 2:30 PM.
A deviation from this schedule can be made. In this case, the companies with whom a framework agreement is concluded will inform them of the change at an early stage.
Tenders can be submitted up to the end of the stated deadline.
2.3.2 Content of the price offer
CBB has the option of choosing between two content variants with regard to the invitation to submit a price offer. The companies with which a framework agreement is concluded are informed in the request to submit a price offer which variant is used.
Variant 1: The CBB requests a delivery price in €/MWh, which is considered to be firmly agreed over the entire delivery period and for the entire quantity requested.
Option 2: The CBB stipulates that the delivery of the requested partial quantity of the current schedule in the respective delivery period is to be settled at the then valid day-ahead auction price of EPEX SPOT for the respective individual hour (published by EPEX Leipzig) plus a surcharge (respective hourly price plus surcharge) multiplied by the fixed delivery quantity for the respective hour in the timetable).
CBB also sets a price cap. If, during a delivery month, there is an average delivery price (sum of the costs per hour divided by the sum of the delivery quantity) that is above the upper price limit, the price of the upper limit will be invoiced.
If variant 2 is selected, the CBB will request the amount of the surcharge (negative surcharges are not excluded) at the current day-ahead auction price from EPEX SPOT for the respective individual hour when requesting a price offer, which is calculated over the entire delivery period and for the entire quantity requested as firmly agreed applies.
2.3.3 Order Placement
After examining the price offers and deciding on the award, the bidder with the cheapest offer to be accepted receives information about the award, or all other bidders receive a rejection.
