The contracting authority intends to enter into a contract with Cubit AS without holding a competition, for procurement of a professional system for inspections. The exception from competition is pursuant to the public procurements regulation, §21-5 and §13-4, and is justified on the grounds that there is only one specific supplier who can provide the service as competition is impossible due to technical reasons.
The contracting authority has assessed the exception in §13-4 in view of the contracting authority's specific situation, and has concluded that there is only one supplier who can provide the service requested by the contracting authority, and that it will be impossible for other potential suppliers to deliver due to technical reasons. Furthermore, it has been decided that potential harm to the supplier market if the procurement is carried out without a competition is less than the harm that would be caused if the procurement is divided or postponed.

The procurement concerns purchase of access to a new professional system (SaaS) that will cover the contracting authority’ implementation of work processes in the preventative work, environmental health and alcohol licensing inspections. This is largely carried out as different versions of inspection processes by different specialist environments. Some processes have a large variation and low volume, whilst others (such as housing inspections with approx. 80,000 objects) have volume and standardised implementation.
